(Project No.: 4660-6X4287). Determine that the conveyance of said easement is in the public interest and will not substantially conflict or interfere with the Contra Costa County's (County) use of the property. Authorize the Chair, Board of Supervisors to execute the Grant of Easement on behalf of the County. Direct the Real Estate Division of the Public Works Department to cause said Grant of Easement and a Certified Copy of this Board Order to be delivered to PG&E. FISCAL IMPACT: 100% Contra Costa Transportation Authority funds. Bueren, Public Works Director/Chief Engineer Date:June 5, 2012 Contra Costa County Subject:Approve the Conveyance of a Grant of Easement to Pacific Gas & Electric Company BACKGROUND: On January 1, 2000, the Board approved Agreement No. 124 for the State Route 4 - Railroad Avenue to Loveridge Road project to provide the right of way services by County staff to Contra Costa Transportation Authority (CCTA). CCTA required a variety of right of way services but has no right of way staff and has contracted with the County for these services. County staff acquired the real property at 2099 Railroad Avenue in Pittsburg (APN: 086-221-028) on July 1, 2002, in the County's name for the widening of State Route 4 - Railroad to Loveridge Project. PG&E requires an easement over a portion of said property for underground electrical facilities relocated for the project. Environmental Clearance is SCH#2000112007. CONSEQUENCE OF NEGATIVE ACTION: The County would not be in compliance with the Utility Agreement that required PG&E to relocate and PG&E would not have the property rights necessary for their relocated electrical facilities.
