HomeMy WebLinkAboutMINUTES - 07102012 - C.85RECOMMENDATION(S): APPROVE and AUTHORIZE the County Administrator, or designee, to execute a contract amendment with the Contra Costa County Bar Association, effective July 1, 2012, to permit the Criminal Conflicts Program director to receive appointments under the program and maintain a caseload of up to three open cases, with no change to the contract payment limit of $3,500,000 annually or term through June 30, 2014, for criminal defense representation of indigents. FISCAL IMPACT: No fiscal impact. The contract modification is not expected to increase the cost of services under this contract because the Director’s services as appointed counsel would otherwise have been performed by another attorney in the Program at an equivalent cost. The County developed the Criminal Conflicts Program with the Bar in response to the escalating cost of conflict defense services under the old system of court-appointed counsel. The Criminal Conflicts Program provides Court-ordered legal representation of accused indigents in cases where the Public Defender or Alternate Defender has a legal conflict of interest or is otherwise unavailable, cases where the Public Defender or Alternate Defender is relieved on motions of defendants for other reasons, for certain witnesses, and for juvenile immigration and certain probate/guardianship cases. In 2010/11, the County's modified contract with the Bar Association prohibited the director from receiving case appointments under the Program to enable the director to focus exclusively on program management. Now, with more experience under this provision, we have determined that it will be in the best interest of the Program and the County to permit the director to maintain a limited program caseload, which will help him to keep abreast of changing court policies and procedures.
