ADOPT Resolution No. 2012/238 approving and authorizing the Director of the Department of Conservation &
Development, or her designee, on behalf of the Successor Agency to the Contra Costa County Redevelopment
Agency, to 1) reenter into the Project Agreement and Work Programs with the Public Works Department for the Iron
Horse Trail Overcrossing, Walden Green II, Contra Costa Centre Infrastructure, Wayfinding Pedestrian Signage,
North Richmond Truck Route Implementation, North Richmond Infrastructure, and Rodeo Infrastructure Projects;
and 2) reenter into the Loan Agreement with the County in the amount of $263,700 for Montalvin Manor
Redevelopment Project establishment costs. There are no changes to the terms of the agreements, nor the payment
limits.
FISCAL IMPACT:
The capital projects are funded with Tax Exempt Bonds. The Walden Green II capital project is also partially funded
with park dedication funds. The Montalvin Manor Loan Agreement if funded by the Private Activity Fund.

Subject:Reentry of Certain Contracts and Agreements between Contra Costa County and the Successor Agency
BACKGROUND:
The former Redevelopment Agency (RDA) had numerous capital improvement projects, funded with bond
proceeds, underway at the time the Dissolution Act (AB x1 26) became effective. These projects were in various
stages of design and development. Several projects are in the design phase, which involve work done in-house by
the County Public Works Department staff. Other projects have been awarded to a third party contractor for
design or construction. The projects that were in the design phase with only a contract with the Public Work
Department are considered null and void pursuant to Section 34171(d)(3) of the Health and Safety Code.
However pursuant to Section 34177(a)(5)(i), the bond proceeds shall be used for the purpose for which the bonds
were sold. In addition, Section 34178 (a) states that a successor entity wishing to enter or reenter into agreements
with the city, county, or city and county that formed the redevelopment agency that it is succeeding may do so
upon obtaining the approval of its oversight board.
The Oversight Board approved reauthorization of the Public Works projects at their April 18, 2012 meeting.
Following is a recap of the projects under consideration, including the reference page and line item number on the
Recognized Obligation Payment Schedule (ROPS), project name and the total outstanding debt as of January 2012:

There are no changes to the terms of the agreements, nor the payment limits.
The former RDA borrowed funds from the County to cover costs to establish the Montalvin Manor
Redevelopment Project Area. The loan in the amount of $263,700 would be determined to be null and void
because the agreement is with the sponsoring community. The Dissolution Act allows for agreements to be
reentered if approved by the Oversight Board. The Oversight Board will consider this agreement at their meeting
on May 22, 2012.
CONSEQUENCE OF NEGATIVE ACTION:
The projects would not gain approval from the Department of Finance and would not be completed. The loan
from the County would not be repaid.
