MATTER OF RECORD
SUBJECT: Workshop on Liability
The Chairman convened the workshop on liability. Phil
Batchelor, County Administrator, described the types of liability
suits involving the County and the problems associated with settling
these claims/lawsuits. He explained the effect "deep pocket" awards
had on the County and cited several examples. The County
Administrator commented on the advantages to the County in having
its own self-insurance program. Mr. Batchelor presented statistical
data on the number of claims filed in the last 10 years and pointed
out that approximately twenty-five percent were awarded a settlement
payment .
Gary Lepper, partner in the law firm of Lepper and Falco,
presented information on the alternative settlement process and spe-
cifically the Bench Bar Settlement Process.
Dick Smith lof Johnson & Higgins Insurance Company spoke on
the status of the insurance industry, problems facing public juris-
dictions, settlements; of claims, and increasing costs of insurance
companies which are passed on to the insured with increased policy
premiums. Mr. Smith commented on the need for tort and liability
reform.
Mark Wasser, General Counsel representing CSAC, spoke about
the need for reform and the initiative being submitted to the elec-
torate to limit liability responsibility. He advised that more
reform is required in the area of liability.
Board members expressed appreciation for the excellent
presentation on liability issues.
