AUTHORIZE the Chief Engineer, Flood Control and Water Conservation District, or designee, to assist the Muir
Heritage Land Trust and East Bay Regional Park District in acquiring additional property on Waterfront Road.
FISCAL IMPACT:
The only cost to the County would be for the staff time working on this project. Staff time expended by each partner
in the property acquisition process would be paid by each partner. Flood Control District and County staff time would
be paid with Flood Control Zone 3B funds (252000) as part of the Walnut Creek channel improvement project.
BACKGROUND:
The Pacheco Marsh property is approximately 120 acres in size and is located on Waterfront Road in the Martinez
area, east of Interstate 680 and adjacent to the Walnut Creek channel. The Flood Control District acquired the
property in partnership with the East Bay Regional Park District and the Muir Heritage Land Trust through a
defaulted tax sale. The Flood Control District, East Bay Regional Park District, and Muir Heritage Land Trust
executed a Memorandum of Understanding

BACKGROUND: (CONT'D)
concerning the Pacheco Marsh property acquisition and disposition. The Memorandum of Understanding was
approved by the Board on July 23, 2002. The Pacheco Marsh property was purchased on September 17, 2002.
The Flood Control District is working with the Army Corps of Engineers on a restoration and flood protection
project on the lower Walnut Creek channel. This project will require mitigation from the regulatory agencies. The
Flood Control District will utilize a portion of the Pacheco Marsh property and restore it as project mitigation.
The East Bay Regional Park District will utilize a portion of the property for a staging area that will link the
intersection of the Bay Trail and Ironhorse Trail. The bulk of the property will be restored to salt marsh habitat
and support special status wildlife species, such as the salt marsh common yellow throat, salt marsh harvest
mouse, suisun song sparrow, and tri-colored black bird. There have also been reportings of California clapper rail
on the property.
When the 120 acre Pacheco Marsh property was acquired in 2002, it extended from Waterfront Road out to an 18
acre parcel at the shoreline. The owner of the shoreline parcel has recently informed the Muir Heritage Land
Trust, the East Bay Regional Park District, and the Flood Control District that they would be willing to sell the
property. Acquisition of these 18 acres adjacent to the Flood Control District owned Pacheco Marsh property
would enhance the restoration efforts for restoring a functional salt marsh habitat and facilitate the acquisition of
grant funds to restore property that extends from Waterfront Road all the way out to the river.
Staff recommends the Board authorize the Flood Control District to assist the Muir Heritage Land Trust and East
Bay Regional Park District in acquiring the parcel. Assistance at this time would only involve staff time and
resources during the acquisition process. Attached is a map showing the potential restoration of the Pacheco Marsh
property and the 18 acre adjacent parcel fronting the Carquinez Straits.
CONSEQUENCE OF NEGATIVE ACTION:
The Muir Heritage Land Trust and East Bay Regional Park District would not have the assistance of the Flood
Control District in acquiring the 18 acre parcel and not be consistent with the spirit of the original Memorandum
of Understanding.
