APPROVE and AUTHORIZE the Director of Conservation and Development, or designee,
to allow the rental of a deed-restricted residential real property located at 1556 Martin
Drive, North Richmond, identified as Assessor’s Parcel Number 408-230-071, to a qualified
tenant for a period of up to two years.
FISCAL IMPACT:
No General Fund impact.
BACKGROUND:
On September 19, 1995, the Governing Board of the Contra Costa County Redevelopment
Agency (Agency) approved the Second Amendment to the Parkway Estates Development
Loan Agreement in North Richmond. This Second Amendment set forth requirements to be
met by local non-profit housing developer Community Housing Development Corporation
of North Richmond to construct 87 for sale single family homes on a 10 acre site formerly
known as 217 West Gertrude Avenue. Twenty-five of the 87 units were required to be sold
to low income homebuyers. In addition, the Agreement stated that all low-income buyers
must enter into a Buyer’s Resale Restriction Agreement (Resale Agreement)

BACKGROUND: (CONT'D)
with the following requirements:
• The units would have 28 year resale restrictions
• The homes must be sold at a restricted price to an income eligible buyer (“Eligible
Purchaser”); and
• The units must be owner-occupied for 28 years
Crystal Barrett-Gabriel purchased her home on June 20, 2001, at which time she also signed
the Resale Agreement. She has since assumed care and control of her elderly aunt who will
be moving in with the family. The residence does not accommodate the needs necessary to
care for this unexpected family member. These medical circumstances compelled
Barrett-Gabriel to request a waiver to rent the property. Her plan is to move into a residence
that is more conducive to her family’s needs and in time, it is the expectation that her aunt
will be moving out to live with with other family members in another state. Once her aunt
has relocated out of state, it is Barrett-Gabriel’s intention to move back into 1556 Martin
Drive and occupy the residence as part of the County’s Affordable Housing Program.
Due to Barrett-Gabriel’s new family member and the medical needs required to care for her
ailing aunt, staff recommends that the Agency allow Barrett-Gabriel to rent her home. The
term of this temporary rental shall be for up to two (2) years. Monthly rents will not exceed
current mortgage payments, including taxes and insurance. The new tenant will not be
entitled to relocation expenses when the lease terminates. The unit must remain affordable
for another low income homebuyer.
If the owner's circumstance has not changed at the end of two years, the Agency can
consider the need to extend the rental time period.
CONSEQUENCE OF NEGATIVE ACTION:
Should the Agency not allow this rental, Barrett-Gabriel will not be able to care for her sick
aunt.
