Approve and authorize the Health Services Director, or his designee, to execute, on behalf
of the County, Contract Amendment/Extension Agreement #27-633-8 with PerformRx,
LLC, a limited liability company, effective April 30, 2012, to amend Contract #27-633-4 (as
amended by #27-633-5 and #27-633-7), to increase the payment limit by $42,000,000, from
$83,000,000 to a new payment limit of $125,000,000 and extend the term from April 30,
2012 through April 30, 2013.
FISCAL IMPACT:
This amendment is funded 100% by Health Plan Member Premiums. (No rate increase)
BACKGROUND:
On June 23, 2009, the Board of Supervisors approved Contract #27-633-4 (as amended by
#27-633-5 and #27-633-7) with AmeriHealth Mercy Health Plan, for provision pharmacy
administration services for Contra Costa Health Plan members, including providing drug
utilization review and management, prior authorization procedures, account management,
member pharmacy call center,

BACKGROUND: (CONT'D)
analysis and reporting services and developing partnerships with prescribers and
pharmacies, for the period from May 1, 2009 through April 30, 2012, including a mutual
indemnification clause for the parties to hold each other harmless for any claims arising out
of the performance of this contract. In April 2010, Assignment Agreement #27-633-5
assigned the Contract from AmeriHealth Mercy Health Plan to PerformRx, LLC.
Approval of Contract Amendment Agreement #27-633-8 will allow the Contractor to
continue to provide pharmacy administration for CCHP members, including an increase of
17% in membership, and continue to mutually indemnify and hold harmless both parties for
any claims arising out of the performance of this contract, through April 30, 2013.
CONSEQUENCE OF NEGATIVE ACTION:
If this amendment is not approved, Health Plan members will not have access to pharmacy
benefits as required by existing State and Federal contracts.
