APPROVE and AUTHORIZE the County Administrator, or designee, to terminate the
contract with New Dawn Technologies, Inc. (“New Dawn”), related to the provision of an
integrated justice case management system, effective May 21, 2012, and APPROVE and
AUTHORIZE County Counsel to initiate litigation against New Dawn.
FISCAL IMPACT:
100% County General Fund. The County has paid $1,482,720 to New Dawn since
execution of the contract, most of which was software licensing fees.
BACKGROUND:
In December 2008, the County, on behalf of its Justice Partners (the District Attorney,
Public Defender, and County Probation Officer), entered into a contract with New Dawn to
provide an integrated, web-based law and justice case management system to replace the

present mainframe system. However, none of the Justice Partners have been able to use the
JustWare system in a “live” production environment because of functionality problems.
Consequently, the County Administrator requests authority from the Board of Supervisors
to terminate the contract and authorize County Counsel to institute litigation against New
Dawn, as steps to attempt to recover amounts paid and other damages. The contract requires
30 days written notice prior to termination.
