APPROVE and AUTHORIZE the County Administrator, or designee, to execute a contract
novation and amendment with Michael W. Foster to extend the contract from March 18,
2012 to December 31, 2012, and increase the payment limit from $85,000 to a new payment
limit of $185,000 for discrimination complaint investigation services as recommended by
the County Administrator. (100% General Fund; Budgeted)
FISCAL IMPACT:
100% County general fund. Budgeted for discrimination complaints.
BACKGROUND:
On March 26, 1993, the County Administrator's Office established Administrative Bulletin
#27.2 detailing the Employment Discrimination and Complaint Procedures. In compliance
with this policy, the Affirmative Action Officer is responsible for responding to all
complaints of harassment and discrimination for the County. Complaints that are not
resolved at the departmental level are investigated by an independent investigator, who has
extensive knowledge of employment

BACKGROUND: (CONT'D)

Foster Employment Law has been in practice in Oakland since 1991, and since 2008 they
have conducted numerous discrimination investigations for the county. They provide
services for a broad spectrum of industry, government, public, private and non-profit
organizations. They are also certified as a minority owned business by the National
Minority Supplier Diversity Council and the California Public Utilities Commission.
CONSEQUENCE OF NEGATIVE ACTION:
The County would not be able to adequately address discrimination and harassment
complaints as required under Federal Law and Administrative Bulletin 27.2.
