FISCAL IMPACT: Settlement amounts are listed below. BACKGROUND: One agreement to settle pending litigation, as defined in Government Code section 54956.9, became final during the period of February 1, 2012 through February 29, 2012. Tindall, et al. v. Hoedt, et al., CCC Sup. Ct. Case No. C09-01694. This case arose out of a motor vehicle accident. A bystander was struck and killed when a vehicle skidded on loose gravel on Marsh Creek Road during the chip seal process in August 2008. The Board of Supervisors authorized settlement in the amount of $9.5 million on January 17, 2012 in closed session, by a 5-0 vote. BACKGROUND: (CONT'D) 2011. The settlement became final on February 24, 2012. The settlement amount will be paid through the Liability Trust Fund, the County Counsels’ Association of California pooling agreement, and Chartis Insurance funds. No agreements to settle pending litigation became final during the period of December 1, 2011 through January 31, 2012. This report includes final settlements of litigation matters handled by the Office of the County Counsel. This report does not include litigation settlements that were previously reported orally in open session or by the Risk Management Division of the County Administrator’s Office as a consent item on the Board’s open session agenda. CONSEQUENCE OF NEGATIVE ACTION: The report would not be accepted. CHILDREN'S IMPACT STATEMENT: N.A.
