APPROVE the Affordable Housing Finance Committee recommendations for the allocation
of $1,925,062 in CDBG funds ($1,245,034 in FY 2012/13 funds, and $680,028 in FY
2011/12 Housing Development Assistance Funds [HDAF]); and
APPROVE the Affordable Housing Finance Committee recommendations for the allocation
of $2,397,645 in HOME Investment Partnerships Act funds ($210,944 in FY 2012/13 funds
and $2,186,701 in FY 2011/12 HOME HDAF); and
APPROVE the allocation of $250,000 in Fiscal Year 2010/11 Housing Opportunities for
Persons with AIDS (HOPWA) funds for the Third Avenue Apartments project in Walnut
Creek.
FISCAL IMPACT:
No General Fund impact. CDBG and HOME funds are provided to the County on a formula
allocation basis through the U.S. Department of Housing and Urban Development (HUD).
HOPWA funds are provided to the County from HUD through the City of Oakland, the
entitlement grantee.

FISCAL IMPACT: (CONT'D)
The Board previously allocated $1,100,000 in HOME funds and $1,050,000 in CDBG
funds to Eden Housing for the Orinda Senior project; and $1,200,000 in HOME funds to
Satellite Housing for the Third Avenue Apartments project in Walnut Creek.
BACKGROUND:
The Affordable Housing Finance Committee (AHFC) is a Board-appointed committee
that develops funding recommendations for the Board of Supervisors concerning the
allocation of CDBG and HOME funds for affordable housing development. The current
funding recommendations are the result of a competitive application process initiated in
October of 2011. A Notice of Funding Availability was sent to over 100 jurisdictions,
public agencies, affordable housing developers and interest groups active in the County.
DCD received 11 applications requesting approximately $14.6 million ($2 million in
CDBG funds and $12.6 million in HOME).
The AHFC met on February 27, 2012 to consider staff funding recommendations for
CDBG-housing and HOME projects. Members of the public, including project sponsors,
were invited to attend and provide input into the allocation process. Following discussion
and comment on each project, the AHFC developed recommendations for the allocation
of CDBG and HOME funds. A summary of the applications and AHFC actions is
attached. The Board is not being asked to approve the AHFC recommendation of
$1,600,000 in HOME funds for the Berrellesa Palms project at this time. This
recommendation will be brought to the Board if and when the City of Martinez
determines that the financing for this project is consistent with its use permit.
The HOPWA funding recommendation is supported by the HOPWA review committee
that includes representatives from the cities of Antioch, Concord, Pittsburg, Richmond,
and Walnut Creek.
The County will enter into various legal documents with the developers for each project.
These documents may include some or all of the following: Loan Agreement, Promissory
Note, Deed of Trust and Security Agreement, Regulatory Agreement, Intercreditor
Agreement, Subordination Agreement, Loan Riders and Estoppels. The form of these
documents will be submitted for Board of Supervisors approval at a later date, but prior
to execution of any legal documents.
All of the housing projects will undergo CEQA review before the County enters into
project agreements and/or loan documents.
FY 2012/13 CDBG, HOME, and Emergency Solutions Grant (ESG) Annual Action
Plan (Action Plan): The projects allocated CDBG, HOME, and HOPWA funds through
this Board action will be incorporated into the Action Plan. The Action Plan will be
submitted to the Board of Supervisors for approval on May 8, 2012.
The funding recommendations for the housing projects are coming to the Board ahead of
the other CDBG projects and programs so that two of the project sponsors can submit
applications for nine percent low income housing tax credits to the California Tax Credit
Allocation Committee in March 2012.
The Action Plan describes the activities the County will undertake during the program
year to address priority needs identified in the Contra Costa County FY 2010-15
Consolidated Plan. The Action Plan identifies the use of grant funds and program income
received during the program year by activity, and proposed accomplishments. The
Action Plan also includes actions the County proposes to undertake during the year to
address obstacles in meeting under-served persons, foster and maintain affordable
housing, reduce the number of households living under the poverty level, and enhance
coordination between public and private housing and social service agencies.
In order to begin the program year on time, the FY 2012/13 Action Plan must be
approved by the Board and submitted to HUD by May 15, 2012.
CONSEQUENCE OF NEGATIVE ACTION:
If the Board does not approve the funding recommendations, the project sponsors for the
Orinda Senior and Third Avenue apartments will not be able to submit applications to the
Tax Credit Allocation Committee and the California Debt Limit Advisory Committee in
March 2012.
CHILDREN'S IMPACT STATEMENT:
The Third Ave project will provide 47 units of rental housing affordable to and occupied
by low income families and thus will support numbers four and five of community
outcomes established in the Children’s Report Card: 4. “Families that are Safe, Stable
and Nurturing”; and 5. “Communities that are Safe and Provide a High Quality of Life
for Children and Families”.
