ADOPT Resolution No. 2012/102 approving the fourth Extension of the Drainage
Improvement Agreement, for drainage area DG 04-00035 (cross-reference subdivision SD
99-08381), for a project being developed by Shapell Homes, a Division of Shapell
Industries, Inc., a Delaware Corp, as recommended by the Public Works Director, San
Ramon (Dougherty Valley) area. (District II)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The Drainage Improvement Agreement needs to be renewed as the improvements are not
completed yet. (Approximately 50% of the work has been completed to date.) The
developer has requested additional time to complete improvements. Granting an extension
gives the developer an additional year to complete the improvements and keeps the bonding
current.

The Drainage Improvement Agreement will not be renewed if the extension is not granted;
the developer cannot complete the improvements; the bonds cannot be kept current; and,
the County may need to foreclose on the developer’s bonds and complete the
improvements.
