APPROVE and AUTHORIZE the Public Works Director to execute the Memorandum of
Understanding between Contra Costa County and East Bay Regional Park District for the
conversion and rehabilitation of a 1.7-mile segment of Carquinez Scenic Drive into a
segment of the San Francisco Bay Trail. (District V)
FISCAL IMPACT:
The MOU allows the transfer of a $1.0 million federal earmark for trail construction from
Contra Costa County to East Bay Regional Park District.
BACKGROUND:
The East Bay Regional Park District (EBRPD) is completing preliminary design and
environmental review work for the proposed “Martinez Intermodal Center to Crockett” Bay
Trail segment along a 1.7-mile segment of Carquinez Scenic Drive in Martinez. They have
allocated $3,622,000 to this project from a $10.2 million “TIGER II (Transportation
Investment Generating Economic Recovery)” grant awarded by the U.S. Department of
Transportation towards a total project cost estimate of approximately $6 million; the balance
of the project will be funded

BACKGROUND: (CONT'D)

In order to satisfy Federal Highway Administration (“FHWA”) requirements for
obligating the TIGER II funds, EBRPD must demonstrate that it has obtained the
permanent rights necessary to construct and maintain the trail. Contra Costa County
holds the public road right of way over Carquinez Scenic Drive; the 1.7-mile segment of
this roadway has been closed to vehicular traffic since the 1980’s due to storm damage.
EBRPD and County staff have prepared an MOU to set forth mutual understandings
between the EBRPD and the County regarding the trail construction project and to satisfy
FHWA right of way certification requirements.
Pursuant to the MOU, the County will transfer a $1 million SAFETEA-LU (Safe,
Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users) federal
appropriation earmark to EBRPD to help fund the trail construction project.
Additionally, once the trail construction project receives environmental clearance from
FHWA and Caltrans under the National Environmental Protection Act, the County will
grant a right of entry to EBRPD within the Carquinez Scenic Drive right of way. The
right of entry will satisfy the FHWA requirement that EBRPD holds the necessary rights
to enter and construct the project.
Upon final project certification and the obligation of TIGER II funds to this project by
FHWA, the County will grant a permanent trail easement to EBRPD within the 1.7-mile
segment of Carquinez Scenic Drive. The County thereafter intends to vacate its public
road rights to this segment of Carquinez Scenic Drive, leaving the trail easement which
will be operated and managed by EBRPD as a segment of the San Francisco Bay Trail.
CONSEQUENCE OF NEGATIVE ACTION:
Contra Costa County’s federal earmark for the project will not be transferred to East Bay
Regional Park District.
