APPROVE the plans, specifications, and design for the above project; and DELEGATE to the Deputy General Services Director, or to any licensed architect or engineer employed by the County the authority to approve any design modifications prepared for the project. 2. AWARD a construction contract in the amount of $213,000 to Marken Mechanical Services, Inc. (“Marken”), the lowest responsive and responsible bidder for the Animal Services Heat Recovery Project; and DIRECT the Deputy General Services Director, or designee, to prepare the contract. RECOMMENDATION(S): (CONT'D) 3. DIRECT that Marken shall submit two good and sufficient surety bonds (performance bond and payment bond) in the amount of $213,000; and ORDER that, after Marken has signed the contract and returned it, together with the bonds, evidence of insurance, and other required documents, and the Deputy General Services Director has reviewed and found them to be sufficient, the Deputy General Services Director, or designee, is authorized to sign the contract for this Board. 4. AUTHORIZE the Deputy General Services Director, or designee, to exonerate any bid bonds posted by the bidders after execution of the above contract. 5. AUTHORIZE the Deputy General Services Director, or designee, to sign any escrow agreements prepared for this project to permit the direct payment of retentions into escrow or the substitution of securities for monies withheld by the County to ensure performance under the contract, pursuant to Public Contract Code Section 22300. 6. AUTHORIZE the Deputy General Services Director, or designee, to order changes or additions to the contract work pursuant to Public Contract Code Section 20142. 7. DELEGATE, pursuant to Public Contract Code Section 4114, the Board's function under Public Contract Code Sections 4107 and 4110, with regards to subletting and subcontracting, to the Deputy General Services Director, or designee. 8. DELEGATE, pursuant to Labor Code Section 6705, to the Deputy General Services Director or to any registered civil or structural engineer employed by the County the authority to accept detailed plans showing the design of shoring, bracing, sloping or other provisions to be made for worker protection during trench excavation covered by that section. FISCAL IMPACT: Funding for the contract is from PG&E’s Energy Efficiency Retrofit Loan Program ($167,992), PG&E rebates ($23,888), and County funds ($21,120). The PG&E Energy Efficiency Retrofit Loan Program is a 0% interest loan for construction costs paid for with annual energy savings ($16,906) not to exceed 10 years. The loan amount will be for $167,992 to be paid over 119 months. Repayment of the loan is made through the monthly utility bill. The objective is to have bill neutrality after the energy efficiency project is completed. BACKGROUND: The Animal Services Facility needs to cool or heat air 7 days a week year round to keep animals and staff comfortable. On a cost per square foot per month basis, electricity for the facility at 4800 Imhoff Drive, Martinez costs $0.27 per square foot, which is the highest electricity cost of all County buildings. As a comparison, the electricity cost per square foot for the Martinez Detention Facility is $0.14 and for the Juvenile Hall is $0.18. This project entails the installation of eight heat recovery systems in the roof top units, resulting in a reduced need for heating and conditioning. The proposed heat recovery system project would reduce annual electricity costs by an estimated $16,906. The plans and specifications were funded from ARRA Energy Efficiency Community Block Grant (EECBG) funds. The project was therefore bid as a EECBG project. Bids were received by the General Services Department on July 12, 2011, and the bid results are as follows: Marken Mechanical Services, Inc. $213,000.00 Performance Bond: $213,000.00 Payment Bond: $213,000.00 Carquinez Heating, Air Conditioning & Sheet Metal $224,711.00 Martinez Sheet Metal, Inc. $241,634.00 Bel Air Mechanical $253,697.00 Johnson Mechanical Contractors $257,900.00 L. Columna General Contractor $265,475.98 Matrix HG, Inc. $357,582.00 R.E. Corporation $362,573.00 General Services staff has reviewed the above bids and has determined that Marken, which submitted the lowest monetary bid ($213,000.00), is the lowest responsive and responsible bidder for this project. Accordingly, the Deputy General Services Director recommends that the construction contract for this project be awarded to Marken in the amount of $213,000.00. The general prevailing rates of wages, which shall be the minimum rates paid on this project, are on file with the Clerk of the Board and copies are available to any party upon request. CONSEQUENCE OF NEGATIVE ACTION: Failure to award the construction contract for the Animal Services Heat Recovery Project would mean continued high electricity bills and the failure to take advantage of a zero percent loan program from PG&E.
