Retirement Board Election Procedures
SPECIFIC REQUEST(S) OR RECOMMENDATION(_S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Concur with changes in procedures for the election of the
second, third, seventh, and eighth members of the Retirement
Board whereby the election will generally be conducted
consistent with the provisions of the California Elections
Code, except that ballots will be distributed to appropriate
members of the retirement system with their paychecks.
Duplicating ballots will be prohibited except that duplicate
ballots will be available from the Elections Office.
2. Authorize Supervisor Fanden to meet with Richard Cabral,
representing the second, third, seventh, and eighth members
of the Retirement Board and Michael Ross, former candidate
for the Retirement Board and staff from the Elections Office
to work out procedures for the conduct of election campaigns
for these four seats on the Retirement Board which will be
reported back to the Internal Operations Committee on March
10 for future report to and consideration by the Board of
Supervisors.
3 . Direct County Counsel to prepare the necessary Resolution to
implement these changes in election procedures and report
their recommendations to the Internal Operations Committee
March 10 for subsequent report to and consideration by the
Board of Supervisors.
BACKGROUND:
On December 17 , 1985, the Board of Supervisors referred to our
Committee a report from the County Administrator recommending
that County Counsel prepare and submit a resolution incorporating
. revised Retirement Board election procedures as suggested by the
Assistant County Registrar.

On February 10, 1986, our Committee met with the Assistant County
Registrar, Retirement Administrator, two members of the
Retirement Board (Mr. Cabral and Ms. Shea) , Mr. Michael Ross, the
General Manager of Local 1, and staff from the County Counsel' s
Office and County Administrator' s Office. Three issues were
outlined:
I. The need for changes in election procedures which would
prevent the possibility of a person voting more than
once, but would maximize the opportunity for members to
vote;
2. Procedures for conducting a campaign for the Retirement
Board; and
3 . The possibility of having a member of the Board of
Supervisors serve on the Retirement Board as is
provided for in State law.
Our Committee reviewed a resolution drafted by County Counsel
which would conform Retirement Board elections to the State
elections code, including mailing ballots to eligible members and
prohibiting the duplication of ballots. Following a discussion
of this procedure, Supervisor Fanden suggested generally
following the proposed resolution except that ballots and related
materials would be distributed with members' paychecks in an
effort to insure that every member received a ballot and
recognized the importance of returning it. This procedure, which
is designed to encourage maximum participation in the election,
while avoiding the possibility of duplicate voting, was
acceptable to all parties present.
In order to develop procedures for conducting an election
campaign, including the use of County time, County telephones,
stationery, interoffice mail, and bulletin boards for campaigning
purposes, Supervisor Fanden agreed to meet with Mr. Cabral and
Mr. Ross, along with staff from the Elections Office, to attempt
to reach agreement on acceptable procedures which would control
the conduct of such campaigns.
This entire matter will be considered by the Internal Operations
Committee again on March 10, following which the Committee will
make further recommendations to the Board of Supervisors.
