FISCAL IMPACT: None; 100 percent of consultant costs are covered by permit application fees. BACKGROUND: The Department of Conservation & Development contracted with Environmental Science Associates (ESA) in December 2009 to prepare the environmental impact report (EIR) for the Tres Vaqueros Windfarm Repowering Project. The contract has been modified twice to increase the payment limit and extend the term. The lastest modification was approved in September 2011, while ESA was working to finish the APPROVE OTHER RECOMMENDATION OF CNTY ADMINISTRATOR RECOMMENDATION OF BOARD COMMITTEE Action of Board On: 02/07/2012 APPROVED AS RECOMMENDED OTHER Clerks Notes: VOTE OF SUPERVISORS AYE:John Gioia, District I Supervisor Mary N. Uilkema, District II Supervisor Contact: Will Nelson, (925) 674-7791 I hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown. ATTESTED: February 7, 2012 David Twa, County Administrator and Clerk of the Board of Supervisors By: June McHuen, Deputy cc: C.34 To:Board of Supervisors From:Catherine Kutsuris Date:February 7, 2012 Contra Costa County Subject:Payment Limit Increase for Contract 45185 BACKGROUND: (CONT'D) Final EIR. Staff had assumed that ESA would be able to substantially rely on the approaches used in completing the Vasco Winds Repowering Project Final EIR, which was certified in April 2011. However, in practice that was not the case. Twice as many comment letters were received on the Tres Vaqueros Draft EIR than on the Vasco Winds Draft EIR and a fair number of unique issues (as compared to Vasco Winds) were raised. These and other factors combined to increase ESA's level of effort beyond what was expected in the September 2011 budget modification. The Tres Vaqueros Final EIR has been certified and the project has been approved, so ESA's final cost is now known. CONSEQUENCE OF NEGATIVE ACTION: If the Board of Supervisors does not take the recommended action, then Environmental Science Associates will not be compensated for work completed on the Final EIR for the Tres Vaqueros Windfarm Repowering Project. CHILDREN'S IMPACT STATEMENT: No impact. ATTACHMENTS Contract Amendment Agreement
