HomeMy WebLinkAboutMINUTES - 02072012 - C.07RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with Area West Environmental Inc. effective February 7, 2012, to include additional tasks to the contract and to increase the payment limit by $29,867 to a new payment limit of $121,152 for evaluation of potential historical resources and dry and wet season sampling for fairy shrimp, Danville area, (District III), Project NO. 0662-6R4131. FISCAL IMPACT: This project is funded 53% Local Traffic Impact Fee Funds and 47% Highway Safety Improvement Program Funds. BACKGROUND: Effective September 15, 2011, on behalf of the Contra Costa County (County), the Public Works Department (Dept.) entered into a standard contract with Area West Environmental Inc. Bueren, Public Works Director/Chief Engineer Date:February 7, 2012 Contra Costa County Subject:APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with Area West Environmental Inc., Danville area BACKGROUND: (CONT'D) Drive to Finley Road project. The contract needs to be amended because during contract activities Contractor identified special status species habitat and discovered potential cultural resources. Pursuant to the Contract’s Service Plan-Section III-D-Task 9, Contractor will conduct extra work at an additional cost. A. During work conducted pursuant to the Contract Service Plan-Section III-D-Task 1-Literature Search and Biological Site Assessment, potential habitat for two special status shrimp species (longhorn fairy shrimp and vernal pool fairy shrimp) was identified. Because the project will impact the resources, Contractor will conduct necessary protocol level surveys to determine presence or absence of these species for NEPA compliance. This service was not scoped in the original cost estimate, as such, the contract must be amended to cover this cost. B. During work conducted pursuant to the Contract Service Plan-Section III-D-Task 3-Literature Search and Archaeological/Historical Assessment, previously recorded cultural resources were discovered. Because the project will impact the resources, Contractor will evaluate necessary resource eligibility for listing on the National Register in order to comply with environmental requirements. This service was not scoped in the original cost estimate, as such, the contract must be amended to cover this cost. This contract amendment is needed to include additional provisions language and increase the contract amount. All other terms and conditions in the Contract entered into on September 15, 2011 between the Dept. and the Contractor shall remain in full force and effect. CONSEQUENCE OF NEGATIVE ACTION: Without Board approval, environmental assessments will not be completed in a timely manner and, therefore, the necessary CEQA, NEPA, and HCP/NCCP clearances will not be obtained.
