Approve and authorize the Health Services Director, or his designee, to execute, on behalf
of the County, Contract Amendment Agreement #26-681-2 with Mark H. Kogan, M.D., a
self-employed individual, effective November 1, 2011, to amend Contract #26-681 to
increase the payment limit by $20,000, from $390,000 to a new payment limit of $410,000,
with no change in the original term of January 1, 2011 through December 31, 2013.
FISCAL IMPACT:
This Contract is funded 100% by Enterprise Fund I. No increase in rates.
BACKGROUND:
On January 11, 2011, the Board of Supervisors approved Contract #26-681 with Mark H.
Kogan, M.D., for the period from January 1, 2011 through December 31, 2013, for the
provision of gastroenterology services including clinic coverage, gastrointestinal laboratory
sessions, consultation, training, on-call coverage and medical and/or surgical procedures.
At the time of negotiations the Payment Limit was

based on target levels of utilization. However, the utilization during 2011 was higher than
originally anticipated. Approval of Contract Amendment Agreement #26-681-2 will allow
the Contractor to provide additional gastroenterology services through December 31, 2013.
CONSEQUENCE OF NEGATIVE ACTION:
If this contract is not approved, this physician would not be able to be reimbursed for
additional gastroenterology services provided in 2011 at Contra Costa Regional Medical
and Contra Costa Health Centers.
