BOYD , Deputy RECOMMENDATION(S): APPROVE the conveyance of real property identified as the Old Fire Station 93 at 215 Second Street, Oakley to the City of Oakley (Oakley), pursuant to Government Code Section 25365. DECLARE that the Board of Supervisors of Contra Costa County (Board) on December 13, 2011, approved a Notice of Intention fixing January 10, 2012 at 9:30 a.m., or thereafter, in its Chambers, County Administration Building, 651 Pine Street, Martinez, California, as the time and place where it would meet to convey the real property described therein to Oakley. Said Notice was duly published in the Contra Costa Times in compliance with Government Code Section 6061. RECOMMENDATION(S): (CONT'D) DETERMINE Old Fire Station 93 to be surplus and no longer necessary for Contra Costa County (County) purposes. AUTHORIZE the Chair, Board of Supervisors to execute the Grant Deed on behalf of the County. DIRECT the Real Property Division of the Public Works Department to cause said Grant Deed to be delivered to Oakley for acceptance and recording in the office of the County Recorder. FISCAL IMPACT: No fiscal impact. BACKGROUND: Old Fire Station 93 (FS93) was built in the 1950’s on property under the County’s ownership. Due to the population growth in Oakley in the last twenty years, FS93 is no longer adequate to service the community. The East Contra Costa Fire Protection District (ECCFPD), the City of Oakley (City), and the County worked together to find a better site to build a new facility for FS93 that will be able to service the community and meet the requirements of the fire staff. Under the “Agreement Among The East Contra Costa Fire Protection District, The County of Contra Costa, The City of Oakley, And The Oakley Redevelopment Agency For The Oakley Fire Station Replacement Project” (Agreement), Oakley is to construct a new fire station on property it owns at 530 O’Hara Avenue and after the new Fire Station 93 is constructed and occupied by staff, Oakley is to grant this property to ECCFPD. In exchange, ECCFPD is to grant its property located near the intersection of Live Oak Avenue & Neroly Road to the City and the County is to grant the FS93 property to the City. The new Fire Station 93 has been constructed and is occupied by fire staff. Both the City and ECCFPD have recently exchanged their properties and the County is now ready to transfer the FS93 property to the City pursuant to the conditions of the Agreement. CEQA was approved by this Board on December 13, 2011[CP #09-68] CONSEQUENCE OF NEGATIVE ACTION: The County will not be in compliance with the terms and conditions of the Agreement and will continue to be responsible for the maintenance of the Property.
