HomeMy WebLinkAboutMINUTES - 12132011 - D.2RECOMMENDATION(S): ADOPT the attached Resolution No. 2011/483 approving an additional extension of the current Memorandum of Understanding between the In-Home Supportive Services (IHSS) Public Authority and SEIU United Healthcare Workers West (UHW) extending negotiated wage agreements and other economic terms and conditions of employment. The term of the MOU will be extended through March 31, 2012. FISCAL IMPACT: The recommendation includes the additional extension of the date in Section 13 – Pension Fund Participation, subsection C. Contributions from December 31, 2011 to March 31, 2012. The 2009-2011 agreement with SEIU-UHW states that $75,000 annually in funding for provider transportation will, instead, be used to offset the pension surcharge costs. It is anticipated that, for the first nine months of the fiscal year, $45,000 in additional pension surcharge costs will be expended during this extension period. These costs are 50% Federal and 50% County. A three month extension was approved by the Board of Supervisors on October 25, 2011 extending the contract until December 31, 2011. By ordinance, the Contra Costa County Board of Supervisors has directed the County Director of Human Resources to serve as the manager of labor relations for the Public Authority. The Union and the Public Authority met on November 22, 2011 to discuss the possibility of extending the current extension through the end of March 2012. The Union agreed with this extension as it will allow them more time to know the impact of new regulations regarding the Community First Choice Option program that may provide additional revenue to In-Home Supportive Services. This extension agrees to amend the date in Section 13 – Pension Fund Participation , subsection C, Contributions from December 31, 2011 to March 31, 2012 (TA attached). It also amends Section 14 - Health/Dental Plan, subsection d, to address the eligibility requirements for providers if a possible across the board reduction in hours of IHSS providers occurs in or about January 2012 (TA Attached). The parties agreed to continue to meet during the extension of the MOU. CONSEQUENCE OF NEGATIVE ACTION: Failure to approve this limited MOU extension will disrupt the pension contributions on behalf of the employees covered by this bargaining unit.
