DETERMINE said Property to be surplus and no longer necessary for county highway purposes. AUTHORIZE the Chair, Board of Supervisors, to execute a Grant Deed on behalf of the County. DIRECT the Real Property Division of the Public Works Department to cause said Grant Deed to be delivered to the City. FISCAL IMPACT: No fiscal impact. Project No.: 4660-6X4152 (District II) [SCH No. 95043029] BACKGROUND: In 1998 the Contra Costa Transportation Authority (CCTA) and the County entered into an Agreement for the County to provide right of way services for the State Route 4 West Gap Project (Project). The terms of the Agreement included; the County initially taking title for various property rights for the Project and to transfer those rights to the appropriate parties at a later date. On February 18, 2010 the County acquired title to the Property from Asbury Graphite for the Project. This area is improved with a leach field for the adjacent property owned by the City. It is in the best interest for the County and the City for the City to take title to the Property. Real Property staff has been directed by CCTA staff to convey fee title to the City of Hercules for the area described in the Exhibit “A”. CONSEQUENCE OF NEGATIVE ACTION: The County would own and be liable for the maintenance of the property. CHILDREN'S IMPACT STATEMENT: Not applicable ATTACHMENTS Grant Deed Exhibit A and B
