1. APPROVE a Third Amendment to Lease with Nancy Weil, Julius Aires, Nina Weil,
Thomas Kasten, Kendra Kasten, Charles Marks, Gladys Marks, Alexander Lithgow, Karen
Lithgow, Robert Kaden, and Eleanor Kaden (Lessors), for a one (1) year term beginning
January 1, 2012, and ending December 31, 2012, and two (2) 1-year extension options, for
approximately 13,995 square feet of office space at 2120 Diamond Boulevard, Suites 200,
220A, and 220B, in Concord, at a monthly rent of $18,193.50 in the first year, for
occupancy by the Health Services Department - Environmental Health Division, under the
terms and conditions set forth in the Third Amendment to Lease.
2. AUTHORIZE the Deputy General Services Director, or designee, to EXECUTE the
Third Amendment to Lease and any extensions to the Lease.
3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under
the California Environmental Quality Act (CEQA). (CP#11-95;WLP751)
4. DIRECT the Department of Conservation and Development Director, or designee, to file
a Notice of Exemption with the County Clerk, and DIRECT the Director of General

for filing of the Notice of Exemption.
FISCAL IMPACT:
The Third Amendment to Lease will obligate the County to pay a total rent of $218,322
over the one (1) year term of the Lease. The Third Amendment to Lease is the extension of
the term of an existing lease and represents a decrease in rent of approximately $105,748 per
year, or approximately 32.6% from the previous rent. Rent during the extension periods will
be $226,719 and $235,116, respectively, if extended.
BACKGROUND:
On April 27, 1999, the Board of Supervisors approved a Lease between the County and
Lessors for occupancy by the Health Services Department - Environmental Health Division.
On July 14, 1999, the Board approved a First Lease Amendment to expand the premises by
1,251 square feet and to extend the term of the Lease. On January 24, 2006, the Board
approved a Second Lease Amendment to expand the premises by 4,233 square feet and to
extend the term of the Lease to December 31, 2011. This Third Amendment to Lease
provides for the County’s continued occupancy of the premises by the Health Services
Department - Environmental Health Division for an additional one year term period.
CONSEQUENCE OF NEGATIVE ACTION:
If this Third Amendment to Lease is not approved, the County would not realize the rent
reductions and would have to relocate the Health Services Department - Environmental
Health Division office to another location at a significant cost.
