APPROVE the conveyance of real property identified as 2555 Harbor Street, Pittsburg
(Property) from the Contra Costa County Fire Protection District to the City of Pittsburg
(Pittsburg), pursuant to Government Code Section 25365.
DECLARE that the Board of Supervisors of Contra Costa County as the Board of Directors
of the Contra Costa County Fire Protection District (Board) on October 25, 2011, approved
a Notice of Intention, fixing November 8, 2011 at 9:30 a.m., or thereafter, in its Chambers,
County Administration Building, 651 Pine Street, Martinez, California, as the time and
place where it would meet to convey the real property described therein to Pittsburg. Said
Notice was duly published in the Contra Costa Times in compliance with Government Code
Section 6061.
DETERMINE said Property to be surplus and no longer necessary for Contra Costa County
or Contra Costa County Fire Protection District (District) purposes.
AUTHORIZE the Chair, Board of Supervisors to execute the Grant Deed on behalf of the
District.

said Grant Deed to be delivered to the Pittsburg for acceptance and recording in the office
of the County Recorder.
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
On May 15, 2007 the Board approved and authorized the Fire Chief of the District to
execute the “Agreement Between Contra Costa County Fire Protection District, The City
Of Pittsburg And The Pittsburg Redevelopment Agency For The Pittsburg Fire
Replacement Project” (Agreement) under Item C-60. Under the terms and conditions of
the Agreement, Pittsburg and the Pittsburg Redevelopment Agency were responsible for
the construction of the new fire station facilities for Station 84, 85 and a fire prevention
bureau facility on property owned by the District. The District was responsible for the
costs of the design and engineering plans of the three facilities. These facilities are
replacing existing facilities that no longer meet the needs of the District. Stations 84 and
85 are constructed and are now in full operation. The fire prevention facility is expected
to be completed and ready for occupancy by November 2011. The District is now ready
to grant the Property to Pittsburg pursuant to the terms and conditions of the Agreement.
In addition to the fire station building being on the Property there is communication
equipment consisting of a 100’ antenna tower, two storage facilities, an emergency
generator and an above ground fuel tank (Equipment). The Equipment is used by the
District, Pittsburg Police Department and County Sheriff Department and it is cost
prohibitive to relocate it. The District is reserving an easement for the Equipment and
access thereto in the Grant Deed to Pittsburg.
After Pittsburg takes title to the Property, the District will transfer the easement and
access rights to the County as the Information and Technology Department is responsible
for the maintenance and operation of the Equipment.
It was previously determined that this real property transaction (DCD/CP# 03-12) is
exempt from the California Environmental Quality Act (CEQA), as a Categorical
Exemption, Class 12. CEQA was previously approved and the Notice of Exemption was
filed on June 13, 2003.
CONSEQUENCE OF NEGATIVE ACTION:
The District will not be in compliance with the terms and conditions of the Agreement
and will continue to be responsible for the maintenance of the Property.
