HomeMy WebLinkAboutMINUTES - 10042011 - C.35RECOMMENDATION(S): ADOPT Resolution No. 2011/415, to apply, effective October 1, 2011, the 2.75% salary reduction provided in the recently adopted Memorandum of Understanding with Professional and Technical Engineers, IFPTE, Local 21, to the salary of employee #56277, a Planner I, whose salary was Y rated effective August 23, 2010, in accordance with Section 4.3 of the Salary Regulations. FISCAL IMPACT: 100% Land Development fee savings of approximately $1,602 in the current fiscal year and $2,136 annually to project costs assigned to the employee. BACKGROUND: On November 2, 2010 the Board of Supervisors adopted Resolution No. 2010/548, which authorized the Y rating of employee #56277, effective August 23, 2010, in accordance with Section 4.3 of the Salary Regulations, to the salary received prior to voluntary demotion. Boyd, Deputy cc: C.35 To:Board of Supervisors From:David Twa, County Administrator Date:October 4, 2011 Contra Costa County Subject:Application of Negotiated Salary Reduction to Employee Paid Under Section 4.3 of Salary Regulations BACKGROUND: (CONT'D) and Technical Engineers, Local 21, for the period of July 1, 2011 through June 30, 2012. This Memorandum of Understanding includes the agreement to reduce the salary of all Local 21 represented employees by 2.75% effective on October 1, 2011. The County Administrator is recommending that the Board of Supervisors now adopt Resolution No. 2011/415 to adjust the salary of employee #56277, who is represented by Local 21, effective October 1, 2011, to reflect the negotiated salary reduction. The County’s Alternate Work Plan Accommodation Program is aimed at facilitating the return to work of County employees with medical restrictions. Under this Accommodation Program, the Department of Conservation and Development, Risk Management and said employee agreed to a voluntarily demotion to the class of Planner I. The employee holds a Master’s Degree in Geology and will use this knowledge to assist with planning reviews of geotechnical issues for land use planning projects. This employee’s education and training will significantly augment the land use planning capabilities of the Department. Section 4.3 of the Contra Costa County Salary Regulations allows the Board of Supervisors to adjust the salary of an employee upon voluntary demotion. Approval of this request will allow the department to continue to compensate the previous incumbent at the Grading Inspector II rate of pay. The salary will remain at this level until such time as the employee has progressed through the planner series to a salary equal to or in excess of the Grading Inspector II class. Given the employee's academic background and specialized experience, establishing the compensation at the current pay rate is appropriate. Most importantly, this allows the implementation of the Alternative Work Plan Agreement which facilitates the return to work for an employee with significant skills. This Alternative Work Plan Agreement was reached with the employee, the Department and Risk Management. Approval of this resolution will ensure that the employee's compensation is reduced commensurate with other employees. His salary will remain at this level until such time that the salary of the classification in which the employee is appoinited (Planner I, II or III) equals or exceeds his salary. At that time he will be compensated commensurate with the status of his classification. CONSEQUENCE OF NEGATIVE ACTION: The employee will be unfairly advantaged in comparison to other employees.
