ADOPT Resolution No. 2011/414 to apply, effective October 1, 2011, the 2.75% salary
reduction provided in the recently adopted Memorandum of Understanding with
Professional and Technical Engineers, IFPTE, Local 21, to the salary of employee #49675,
an Administrative Services Assistant III, whose salary was Y rated effective May 3, 2010 in
accordance with Section 4.3 of the Salary Regulations.
FISCAL IMPACT:
Savings of approximately $1,805 in the current fiscal year and $2,407 annually, 20%
County, 40% State, 40% Federal.
BACKGROUND:
On May 18, 2010, the Board of Supervisors adopted Resolution No. 2010/285, which
authorized the Y rating of employee #49675, effective May 3, 2010, in accordance with
Section 4.3 of the Salary Regulations, to the salary received prior to voluntary demotion.
On September 13, 2010, the Board of Supervisors adopted Resolution No. 2011/352
approving the Memorandum of Understanding with Professional and Technical

Subject:Application of Negotiated Salary Reduction to Employee Paid Under Section 4.3 of Salary Regulations
BACKGROUND: (CONT'D)
Engineers, Local 21, for the period of July 1, 2011 through June 30, 2012. This
Memorandum of Understanding includes the agreement to reduce the salary of all Local
21 represented employees by 2.75% effective on October 1, 2011. The County
Administrator is recommending that the Board of Supervisors now adopt Resolution No.
2011/414 to adjust the salary of employee #49675, who is represented by Local 21,
effective October 1, 2011 to reflect the negotiated 2.75% salary reduction.
As part of the Employment and Human Services Department's administrative
reorganization, the responsibilities of the Facilities Unit changed. The duties of the
EHSD Facilities Manager diminished over time due to the completion of the
Department's major capital projects.
The change in duties resulted in the need to reorganize to a more appropriate span of
control for the position consistent with the Department's ongoing commitment to
organization balancing. Accordingly, the EHSD Facilities Manager incumbent
voluntarily demoted to an Administrative Services Assistant III at the Department's
request.
Section 4.3 of the Contra Costa County Salary Regulations allows the Board of
Supervisors to adjust the salary of an employee upon voluntary demotion.
Approval of this resolution will ensure that the employee's compensation is reduced
commensurate with other employees. His salary will remain at this level until such time
that the salary of the Administrative Services Assistant III class is equal to or exceeds his
salary. At that time, he will be compensated commensurate with his status of an
Administrative Services Assistant III.
CONSEQUENCE OF NEGATIVE ACTION:
The employee will be unfairly advantaged in comparison to other Local 21 employees.
