Boyd , Deputy RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to enter into a Waiver of Claims and Indemnification Agreement with the Metropolitan Transportation Commission (MTC) as required for the Program for Arterial System Sychronization (PASS) Grant. FISCAL IMPACT: No fiscal impact. BACKGROUND: In April of 2011, the Town of Danville applied for, and was awarded, a grant as part of the Metropolitan Transportation Comission's Program for Arterial System Sychronization (PASS). BACKGROUND: (CONT'D) The project consists of retiming 30 traffic signals located on two major arterials along the same commute corridor in the Town of Danville. The project will provide coordinated signal timing to improve traffic progression along the corridor. Of the 30 traffic signals along the commute corridor, there are 5 signals on Camino Tassajara that are currently owned and maintained by Contra Costa County. The Town of Danville is the project's primary sponsor, while Contra Costa County is a participating agency. The Waiver of Claims and Indemnification Agreement with the Metropolitan Transportation Commission is necessary for the project to proceed forward and include the County's signals. CONSEQUENCE OF NEGATIVE ACTION: Failure to enter into the Waiver Agreement with the Metropolitan Transportation Commission will remove the County owned signals from the PASS Project.
