Duarte, Administrator of the Estate of Floyd P. Wharton, for the property located at 1574 Viera Avenue, Antioch, CA 94509 and identified as Assessor’s Parcel Number 051-071-004. (District V) AUTHORIZE the Public Works Director, or designee, to execute said Right of Way Contract on behalf of Contra Costa County (County). RECOMMENDATION(S): (CONT'D) AUTHORIZE the Auditor-Controller to issue a check in the amount of $58,579.00 payable to Fidelity National Title Insurance Company, 1646 N. California Blvd., Suite 103, Walnut Creek, CA 94526; their Escrow No. 10-334769; Attention: Debbie Heiden, phone (925) 952-8750 ext. 201. DIRECT the Real Property Division of the Public Works Department to have the above referenced Grant Deed delivered to the Title Company for recording in the Office of the County Recorder. FISCAL IMPACT: The estimated project cost is $750,000 funded by 68% of the Bicycle Transportation Account (BTA) Grant, 11% of the Transportation Development ACT (TDA), and 21% of Local Funds (ACQ/3540) DCD-CP# 10-70. BACKGROUND: On January 25, 2011, this Board adopted the Negative Declaration and Finding of No Significant Impact pertaining to the Viera Avenue Bike Lane Project. The purpose of this project is to provide a Class II bike lane facility along Viera Road, between East 18th Street and Wilbur Avenue. Drainage improvements are necessary to address ponding water on the pavement at the intersection of Brown Lane and Viera Avenue. This parcel will be used to construct a shallow infiltration basin which will be approximately 50 feet wide by 110 feet long and 5 feet deep which is just west of the intersection. An underground storm drain will be installed to drain the existing ponding area to the new basin. The basin will be gated for safety and security purposes and the Vector Control District will be made aware of the facility for vector control purposes. CONSEQUENCE OF NEGATIVE ACTION: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications which may jeopardize funding.
