Boyd , Deputy RECOMMENDATION(S): APPROVE and AUTHORIZE the Board Chair, and the Public Works Director, or their designees, to execute an “Agreement and Grant of Easement” and “Right of Entry Permit” with the State of California, Department of Parks and Recreation (State) to acquire easements and access to real property necessary for Contra Costa County’s (County) Marsh Creek Road Widening Project (Project). ACCEPT the “Agreement and Grant of Easement” from the State. RECOMMENDATION(S): (CONT'D) APPROVE payment in the amount of $2,500 for said property rights and AUTHORIZE the Auditor Controller to issue a check payable to State of California, One Capitol Mall, Suite 410, P. O. Box 942896, Sacramento, CA 94296. DIRECT the Real Property Division to have the above referenced “Agreement and Grant of Easement” recorded in the Office of the County Recorder and deliver the “Right of Entry Permit” and payment of $2,500 to the State. FISCAL IMPACT: There is no impact to the County General Fund. Funding is from 63% Proposition 1B State Funds, 36% High Risk Rural Road (HR3) Federal funds, and 1% local gas tax. BACKGROUND: The property rights from the State are required to construct the Project in accordance with the approved plans and specifications. The Project calls for the widening of the travel lanes from ten (10) feet to twelve (12) feet, add eight (8) foot wide shoulders to both sides of the road, move both property fences and utility poles further inland, improve drainage, realignment of curves and slopes for better visibility and add a Class III Bike Route. The Board previously adopted a Mitigated Negative Declaration and Mitigation and Monitoring Reporting Plan for this activity on March 1, 2011. CONSEQUENCE OF NEGATIVE ACTION: The County would not be able to improve Marsh Creek Road west of East Bay Regional Park District’s Round Valley Preserve to Lydia Lane without these property rights.
