ATTESTED: September 27, 2011 David Twa, BY:June McHuen , Deputy RECOMMENDATION(S): Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Contract Amendment Agreement #22–940–9 with Public Health Foundation Enterprises, Inc. (dba PHFE Management Solutions), a non-profit corporation, effective June 1, 2011, to amend Novation Contract #22–940–6 (as amended by Contract Amendment Agreement #22–940–7), to increase the payment limit by $10,938, from $158,812 to a new payment limit of $169,750, with no change in the original term of July 1, 2010 through June 30, 2011, and no change in the automatic extension payment limit of $39,703, through September 30, 2011. FISCAL IMPACT: This Contract is 100% federally funded, through the State, under Title III C 1 and Title III C 2 of the Federal Older Americans Act of 1965. No County funds are required. (No rate increase) BACKGROUND: On July 13, 2010, the Board of Supervisors approved Novation Contract #22–940–6 (as amended by Contract Amendment Agreement #22–940–7) with Public Health Foundation Enterprises, Inc. (dba PHFE Management Solutions), for coordination and supervision of Meals on Wheels activities for Fiscal Year 2010-2011. In June 2010, the County Auditor incorrectly charged Contractor’s Demand against the Fiscal Year 2010-2011 contract instead of the Fiscal Year 2009-2010 contract. Due to insufficient funds, County was not able to pay Contractor’s Demand for June 2011, in the amount of $10,938. Approval of Contract Amendment Agreement #22–940–9 will allow County to pay for services requested by County, and provided, in good faith, by Contractor, through June 30, 2011. CONSEQUENCE OF NEGATIVE ACTION: If this amendment is not approved, Contractor will not be paid for Senior Nutrition Program services provided through June 30, 2011.
