ATTESTED: September 27, 2011 David Twa, BY:KATHERINE SINCLAIR , Deputy RECOMMENDATION(S): ACCEPT resignation of John Jewell from the East Contra Costa Fire Protection District Board of Directors; DECLARE vacant the Board of Supervisors Appointee Seat No. 2 on the East Contra Costa Fire Protection District Board of Directors; and, RECOMMENDATION(S): (CONT'D) DIRECT the Clerk of the Board to post the vacancy, as recommended by the Internal Operations Committee. FISCAL IMPACT: No impact. BACKGROUND: On October 27, 2009, the Board of Supervisors (BOS) adopted Resolution No. 2009/940 consenting to a change in the governing structure of the East Contra Costa Fire Protection District (ECCFPD) from a board of directors comprised of the Contra Costa County Board of Supervisors to a board of directors appointed by the cities of Brentwood and Oakley and the County. The new governing structure consists of nine directors; four from the City of Brentwood, three from the City of Oakley, and two appointed by the Board of Supervisors. On May 3, 2011, the BOS accepted a recommendation from the Internal Operations Committee (Agenda Item C.31) to appoint John Jewell, resident of Discovery Bay, to the Board of Supervisors Appointee No. 2 seat on the ECCFPD Board of Directors. Mr. Jewell replaced Chris Finetti who had resigned from the seat previously. On September 14, 2011, Director Jewell notified the Supervisor Piepho, as Chair of the Internal Operations Committee, that he wished to resign effective immediately. This action requests the Board of Supervisors to accept the resignation of John Jewell from the ECCFPD Board of Directors and directs the Clerk of the Board to post the vacancy pursuant to the Maddy Act of 1975. CONSEQUENCE OF NEGATIVE ACTION: The unscheduled vacancy will not be properly acknowledged by the Board of Supervisors as required by the Maddy Act of 1975. CHILDREN'S IMPACT STATEMENT: No impact.
