ADOPT Resolution No. 2011/386 accepting completion of improvements per Road
Improvement Agreement for development permit DP 07-03064, Walnut Creek area.

FISCAL IMPACT:
No fiscal impact to County Funds. The funds to be released are developer fees that have
been held on deposit pending completion of the warranty period.
BACKGROUND:
The developer has completed the improvements per the Road Improvement Agreement, and
in accordance with the Title 9 of the County Ordinance Code
CONSEQUENCE OF NEGATIVE ACTION:
The completion of the road improvements will not be accepted as complete. The developer
will not receive a refund of the cash deposit. The road improvement agreement and
performance/maintenance surety bond will not be exonerated, and the billing account will
not be closed and liquidated.
