HomeMy WebLinkAboutMINUTES - 09202011 - C.03RECOMMENDATION(S): ADOPT Resolution No. 2011/384 accepting completion of private improvements for minor subdivision MS 04-00015 as recommended by the Public Works Director, Walnut Creek area. (District II) FISCAL IMPACT: No fiscal impact to County Funds. The funds to be released are developer fees that have been held on deposit pending completion of the warranty period. BACKGROUND: The developers Ben Simhayoff and Oscar Herscu, completed the private road improvements as required in the improvement plans and in conformance with the County Ordinance Code, per the Subdivision Agreement. CONSEQUENCE OF NEGATIVE ACTION: The private road improvements will not be accepted as complete, the developer will not receive a refund of the cash deposit, the Subdivision Agreement and performance/maintenance surety bond will not be exonerated, and the billing account will APPROVE OTHER RECOMMENDATION OF CNTY ADMINISTRATOR RECOMMENDATION OF BOARD COMMITTEE Action of Board On: 09/20/2011 APPROVED AS RECOMMENDED OTHER Clerks Notes: VOTE OF SUPERVISORS AYE:John Gioia, District I Supervisor Gayle B.
