HomeMy WebLinkAboutMINUTES - 09202011 - C.02RECOMMENDATION(S): APPROVE the conveyance of Development Rights, by Quitclaim Deeds, to Reclamation District 800 (District 800) for Grant Deed of Development Rights (Environmental Reserve) over a portion of Parcel B and C Subdivision MS 39-91 176 PM 14 recorded on December 30, 1998 Document No. 98-0330170; Grant Deed of Development Rights over a portion of Parcel B Subdivision MS 39-91 176 PM 14 recorded on December 30, 1998 Document No. 98-0330171; and Grant Deed of Development Rights over a portion of Parcel C Subdivision MS 39-91 176 PM 14 recorded on December 30, 1998 Document No. 98-0330172, pursuant to Government Code Section 25526.5, and FIND that the proposed conveyances of Development Rights, by Quitclaim Deeds, to District 800 will not have a significant effect on the environment, and that it has been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061 (b) (3), and DIRECT the Director of the Department of Conservation and Development (DCD) to file a Notice of Exemption with the County Clerk, and APPROVE OTHER RECOMMENDATION OF CNTY ADMINISTRATOR RECOMMENDATION OF BOARD COMMITTEE Action of Board On: 09/20/2011 APPROVED AS RECOMMENDED OTHER Clerks Notes: VOTE OF SUPERVISORS AYE:John Gioia, District I Supervisor Gayle B. Bueren, Public Works Director/Chief Engineer Date:September 20, 2011 Contra Costa County Subject:APPROVE the conveyance of Development Rights by Quitclaim Deeds to Reclamation District 800, Discovery Bay area. Project No. FS10-11. CP No.:11-40 DIRECT the Public Works Director, or designee, to arrange for payment of the $50.00 fee to the County Clerk RECOMMENDATION(S): (CONT'D) for filing and a $25.00 fee to the DCD for processing of the Notice of Exemption, and DETERMINE that the conveyance of Development Rights are in the public interest. AUTHORIZE the Chair, Board of Supervisors, to execute the Quitclaim Deeds on behalf of the County, and DIRECT the Real Property Division of the Public Works Department to cause said Quitclaim Deeds to be delivered to Old Republic Title Company, 1512 Eureka Road, Suite 120, Roseville, CA 95661, for acceptance and recording in the Office of the County Recorder. FISCAL IMPACT: The funds for this project are Fee for Service, FS10-111 (100%). BACKGROUND: Reclamation District 800 is in escrow to purchase property owned by developers, Bixler Business Park and Pacific/Bowie-Tracy II, for the construction of a bio-filter retention pond in lower Kellogg Creek in the Discovery Bay area. The parcels being acquired for this project are encumbered with Grant Deeds of Development Rights in favor of the County. The close of escrow for this transaction is subject to the County providing Quitclaim Deeds to eliminate its Development Rights. CONSEQUENCE OF NEGATIVE ACTION: The County’s development rights will not be quitclaimed and will continue to encumber the parcels. CHILDREN'S IMPACT STATEMENT: Not applicable.
