APPROVE a Lease with Paula Ardizzoia-Harvey, for the five-year period commencing October 1, 2011 and ending September 30, 2016, for a garage and driveway at 49 Canyon Lake Drive, Port Costa, for continued occupancy by the Crockett-Carquinez Fire Protection District, under the terms and conditions set forth in the Lease. 2. AUTHORIZE the Deputy General Services Director, or designee, to EXECUTE the Lease, and EXERCISE any options to extend the Lease. 3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP#11-23; WLP706) 4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy General Services Director, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption. The Lease continues the occupancy by the District for another five years at the same rent the District has paid for the past five years, and includes one additional five-year option to extend the Lease at a rent of $450 per month. Lease costs were anticipated and budgeted in the Crockett-Carquinez Fire Protection District’s FY 2011/12 budget. The District has the right to terminate the Lease at any time with one hundred twenty days prior written notice. BACKGROUND: On September 26, 1978, the Board of Supervisors approved a Lease between the Crockett-Carquinez Fire Protection District and John Ardizzoia and June Ardizzoia, for occupancy by the District. The garage was designed and built specifically to shelter and store a fire truck that services the Port Costa area by the District. The lease with John and June Ardizzoia expired on November 30, 2010, and the District has remained on the site on a month to month holdover. The property has since been inherited by the Ardizzoia’s daughter, Paula Ardizzoia-Harvey. This lease will continue the District’s occupancy of the garage and driveway, but with the new Lessor, Paula Ardizzoia-Harvey. As part of the RAMP evaluation, it was determined there were no County-owned facilities in the region that could be used for this occupancy. CONSEQUENCE OF NEGATIVE ACTION: If the Lease is not approved, the District would have to relocate its fire truck and related fire equipment to another location at additional expense to make the new location suitable for the District’s needs.
