SUBJECT: COMMENTS ON DWR/DFG AGREEMENT ON FISH MITIGATIONS

RECOMMENDED ACTION
AUTHORIZE Community Development Department to sign a letter to the Depart-
ment of Water Resources and the Department of Fish & Game transmitting
comments on the proposed agreement between the two agencies for mitigation
of fish losses from the State Water Project Export Pumping Plant.

REASONS FOR RECOMMENDATION/BACKGROUND
The County has received a copy of a draft agreement between the Department
of Water Resources and the Department of Fish & Game (dated October 30 ,
1986 ) for the purposes of offsetting direct fish losses from the Delta
Pumping Plant. The agreement only applies to the State Pumping Facility
and only for direct impacts from the pumping facility itself. Other
impacts to fisheries from the Federal Pumping Project and other State
facilities are not included in this agreement.
This agreement is significant in that the State Water Project contractors
have admitted that the State Water Project pumping plants have an impact on
the fishery resources and are willing to pay for mitigations. This
agreement could result in future similar types of agreements for other fish
and wildlife impacts from water facilities.
The Fish & Wildlife Study Committee reviewed the agreement at their
December 4, 1986 meeting. Their comments will be incorporated into the
letter. The Water Agency attorney has also been contacted to include his
comments.

MITIGATIONS
The basic concept of the agreement merits support, but the letter needs to
acknowledge that it is for a very specific project in the Delta and makes a
significant, but small, first step in mitigating the impacts of water
projects on fishery resources. The initial payment of $15 million is
inadequate and should be increased to at least $30 million. The agreement
should also not have a reference to any endorsement of a through-Delta
facility.
