HomeMy WebLinkAboutMINUTES - 09132011 - C.77RECOMMENDATION(S): APPROVE and AUTHORIZE the Agricultural Commissioner, or designee, to execute Agreement #11-0363-SF with the California Department of Food and Agriculture in an amount not to exceed $32,388.90 to reimburse the County for regulatory work for the Light Brown Apple Moth, for the period July 1, 2011 though September 30, 2011, as recommended by the Agricultural Commissioner. FISCAL IMPACT: This agreement reimburses the County for expenditures incurred July 1, 2011 through September 30, 2011 not to exceed $32,388.90. BACKGROUND: The Light Brown Apple Moth (LBAM) was first detected in Contra Costa County on March 7, 2007. In addition, LBAM was also detected in five San Francisco Bay Area counties including Santa Cruz, Solano and Monterey as well as Sonoma and Santa Barbara. Guise, Director of Agriculture/Weights & Measures Date:September 13, 2011 Contra Costa County Subject:Agreement #11-0363-SF Light Brown Apple Moth (LBAM) Regulatory BACKGROUND: (CONT'D) Contra Costa County, as well as, areas within the other counties mentioned. On May 2, 2007 the United States Department of Agriculture (USDA) issued a Federal Domestic Quarantine Order (DA-2007-42), regulating the interstate movement of host material from the infested areas of California and all of Hawaii. This regulation requires all nurseries, green waste facilities, community gardens and harvested commodities within the infested areas be issued a quarantine compliance agreement and be inspected every 30 days. On November 8, 2007, an emergency amendment to Section 3434 became effective that removed a quarantined area in Oakley and Danville: however new regulated areas have been established since then in other portions of the County as LBAM continues to be detected. The State of California, Department of Food and Agriculture has established funding for reimbursing the County for expenditures incurred for performing regulatory work for the Light Brown Apple Moth, which includes implementing the Federal Domestic Quarantine Order, and the California State Interior Quarantine, in addition to conducting emergency response activities as a result of detections of LBAM in regulated establishments. CONSEQUENCE OF NEGATIVE ACTION: Failure to accept Agreement #11-0359-SF will mean that the Department will be unable to hire employees for regulatory work for the Light Brown Apple Moth. This may also result in harm to the State of California and other non-infested entities through the potential artificial introduction of the pest outside of the quarantine area which could cause substantial damage to agriculture and the environment.
