APPROVE and AUTHORIZE the Agricultural Commissioner, or his designee, to execute
Agreement #11-0359-SF with the Department of Food and Agriculture (CDFA) in the
amount of $74,417.00 to perform regulatory enforcement activities related to Sudden Oak
Death disease, for the period of July 1, 2011 through June 30, 2012, as recommended by the
Agricultural Commissioner.
FISCAL IMPACT:
This agreement reimburses the County for expenditures incurred July 1, 2011 through June
30, 2011 not to exceed $74,417.00.
BACKGROUND:
The California Department of Food and Agriculture is the lead agency for a Multi-Agency
Task Force, known as the California Oak Mortality Task Force (COMTF), which was
formed to develop a coordinated effort to address what is called Sudden Oak Death. Due to
CDFA's responsibility under the COMTF and its statutory authority to establish quarantines,
CDFA must enter into a cooperative agreement with impacted counties in

BACKGROUND: (CONT'D)
order to comply with the requirements of Assembly Bill 62 (Migden).
The role of the County Department of Agriculture is to perform regulatory inspection
activities, to issue compliance agreements, and to do related work that will assure affected
businesses including plant nurseries, firewood dealers, tree services, green waste and
compost facilities, etc., are in compliance with regulations designed to stop the spread of
this disease to non infested areas of the state, country and foreign countries. CDFA
reimburses the County for all costs involved in this program.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to accept Agreement #11-0359-SF will mean that the Department will be unable to
hire employees for regulatory enforcement activities related to Sudden Oak Death disease.
This may also result in harm to the State of California and other non-infested entities
through the potential artificial introduction of this disease which could cause substantial
damage to agriculture and the environment.
