RCD is now requesting a loan in the amount $191,000 from the $530,000 that was previously allocated to them on January 11, 2011. The purpose of the Riley Court project is to improve 48 units of rental housing affordable to and occupied by lower income families, including those with HIV/AIDS in Concord and Central County. RCD is the developer of the project, which involves the rehabilitation of 41-one bedroom units and 7-two bedroom units. Five of the one bedroom units will be designated for persons living with HIV/AIDS. In accordance with HOPWA regulations, RCD will contract with the County's Health Services Department's (HSD) Homeless Program to be the lead service agency and direct provider of services to residents of Riley Court. RCD acquired the property in 1997 with financing from the Contra Costa County HOME program, the City of Concord, and other sources. The project will be constructed in two phases. The Phase 1 scope of work will include demolishing the pool and replacing with sod planting, installing new bathroom exhaust system to reduce moisture, replacing mailboxes to prevent water intrusion, and increasing site lighting for security purposes. Phase 1 construction is scheduled to begin in September 2011 with a construction completion of December 31, 2011. Phase 1 will provide two HOPWA units. Phase 2 of the project is still in the initial stage of development and RCD is working on putting the financing project together. RCD will be applying for Multi Family Housing Program (MHP) funds in August and expect an award of $1,200,000 to $1,900,000 in December 2011. If awarded MHP funds, the Phase 2 scope of work will include additional landscaping and tree repair, extensive upgrades to the unit interiors including new cabinetry and energy star appliances, repairs to the unit doors and new hardware, painting the building exterior and unit interiors as needed, repairs to unit bathrooms and replacement of vinyl, shower surrounds, shower heads, and toilets as needed, repairs to the concrete to eliminate trip hazards, replace closet doors, remodel the community room, install programmable thermostats, replace AC system as needed, and install hardwired smoke detectors. Staff will return to the Board at a later date for approval of the Phase 2 HOPWA legal documents. Phase 2 will provide three HOPWA units. The total cost of Phase 1 of this project is $191,000. The proposed development budget and sources of funds for this project are: Source Amount HOPWA funds $191,000 Funds will be lent with no interest and a term of 55 years. The County loan documents for this project include the following: • Regulatory Agreement and Declaration of Restrictive Covenants; • Deed of Trust with Assignment of Rents, Security Agreement and Fixture Filing; • Promissory Note; and • HOPWA Loan Agreement This recommended action includes authorization to execute any and all documents and to take any and all actions necessary to implement the activities authorized under the Loan Documents, including execution of loan amendments or modifications for the purposes of agreeing to reasonable extensions of time deadlines. CONSEQUENCE OF NEGATIVE ACTION: If this loan is not authorized, RCD would not be able to improve and provide the HOPWA units.
