FISCAL IMPACT:
There will be a net increase in annual cost of $106,483 ($88,736 this fiscal year). These
personnel actions will be fully funded by new revenues from SB676, which increased the
base recording fee to cover costs of recording and indexing documents in the Recorder's

BACKGROUND:
SB676 passed in October 2009. This bill allowed counties to increase their base recording
fee to cover the cost of recording and indexing documents. The Clerk Recorder
conducted an analysis with the assistance of the Auditor/Controller to determine the cost
of processing documents to be recorded and indexed. This analysis confirmed that the
Clerk-Recorder did not recover the full cost it incurred while providing those services.
The County Clerk-Recorder received approval from the Board on December 15, 2009 to
increase fees in order to cover the cost of providing services and to provide funding to
reorganize the division to increase customer service. The Board directed the Human
Resources Department to conduct classification studies, with the goal to establish the
classifications of Clerk-Recorder Services Technician, Specialist, Supervisor and
Manager. The objective of the classification studies was to create a new, higher trained
and more technical classification structure so that all front line imployees in the
Clerk-Recorder division could competently assist any customer, instead of the bifurcated
(Clerk and Recorder) system that has been in place for many years. This often leaves
customers for one or the other group waiting in long lines. The first round of recruitments
and appointments was made in late 2010. Recent vacancies and other staff departures
have created nine more vacant positions. The department is requesting to fill the
vacancies with the new established Clerk-Recorder classifications outlined above.
CONSEQUENCE OF NEGATIVE ACTION:
The funding from SB676 must be used for the recording and indexing of documents in
the Clerk-Recorder Department. If this action is not approved, the Clerk Recorder
Department will not have the appropriate classification where required. And, staff will
continue the practice of a bifurcated process, whereby certain staff handle recording
documents and certain staff handle clerk documents. Furthermore, the Clerk-Recorder
Department will lose an opportunity to increase positive customer support to County
constituents and will cause the department to rescind the fee increase and lose revenue of
up to $1,800,000.
