HomeMy WebLinkAboutMINUTES - 08092011 - C.38RECOMMENDATION(S): FIND that the Grant of Easement to the West County Wastewater District (WCWD) is in the public interest and that the easement will not substantially conflict or interfere with the County’s use of the property. APPROVE the Grant of Easement to WCWD for property rights needed in connection to the West County Health Center Project (Project); pursuant to Government Code Section 25526.6, and AUTHORIZE the Chair, Board of Supervisors, to execute said Grant of Easement on behalf of Contra Costa County (County). ACCEPT a Quitclaim Deed from WCWD for a sanitary sewer easement which is being relocated. DIRECT the Real Property Division of the Public Works Department to deliver a certified copy of this Board Order and the Grant of Easement to WCWD for acceptance and recording in the office of the County Recorder and DIRECT the Real Property Division to have said Quitclaim Deed recorded in the Office of the County Recorder. Project No.: 5024-6X5141 (District I) FISCAL IMPACT: No fiscal impact. BACKGROUND: On October 14, 2010, the County acquired a 2.8-acre property in the City of San Pablo for the West County Health Center. That property is currently subject to WCWD's existing sewer easement, which is located in an area that will be occupied by the proposed health center facility. Real Property Division staff negotiated with WCWD to relocate the easement in order to accommodate the County's project, and to continue to provide WCWD an easement to operate and maintain sewer facilities to serve the property. Those negotiations resulted in the proposed action. If the proposed action is approved, the County will issue a Grant of Easement in favor of WCWD to replace WCWD's existing easement; and County will accept a quitclaim deed that conveys WCWD's existing easement to the County. This exchange will enable the facility to be constructed, as designed, and will avoid project delays. CONSEQUENCE OF NEGATIVE ACTION: The County will not be able to construct the West County Health Center according to approved plans and specifications. CHILDREN'S IMPACT STATEMENT: Not applicable.
