Authorizes appropriation adjustments of $66,715 to pay for additional staff to administer the Abandoned Vehicle Program through the remainder of this fiscal year. 2. Approve Building Inspection procedures for administering the Abandoned Vehicle Program. 3 . Approve the proposal to be sent to towing companies for towing services. 4. Refer to County Counsel, Building. Inspection and Community Development the completion of the development of citation authority for the Abandoned Vehicle Program and code enforcement program. 5. Request a status report from Building Inspection on the program' s operation be made to the Board in 90 days. BACKGROUND: In response to Board referrals, the responsibility for administering an Abandoned Vehicle Program was given to the Building Inspection Department by Ordinance 86-58 . After reviewing the ordinance, Building Inspection staff developed operating procedures and cost estimates for this program. Initially, the program should require one full-time Building Inspector and one half-time clerk to get the program started. Additionally, Community Development is presently employing a consultant on code enforcement. However, no further funds exist for this person. Because of the person' s demonstrated expertise in code enforcement, it is Building Inspections ' intent to keep this person and utilize his skills to assist the abandoned vehicles programa Funding will be provided until the current fiscal year ends. (Attachment 1) . Towing companies have not wanted to provide service as the revenue from dismantling the cars was not sufficient. Building Inspection identified several towing companies who are willing to handle Contra Costa' s abandoned vehicles. Building Inspection has developed requirements for these companies (Attachment 2) . Pursuant to the comments by County Counsel (Attachment 3) , these companies will be contracted to tow abandoned vehicles. For some time, the lack of an abandoned vehicle program has been of concern to the Board, County staff and the public. To administer the program, procedures have been developed by the Building Inspection Department. Attachment ( 4) . In conjunction with the question of abandoned vehicles and overall code enforcement, County Counsel has been developing procedures for administering non-traffic citations. A proposal on that procedure is now being reviewed by the Judicial Council of California and Municipal Court Clerks of Contra Costa. It is anticipated that any resulting modifications in the citation authority procedures will be incorporated in the abandoned vehicle and code enforcement program. This is expected to occur within the next month. Given the nature of identifying, removing, storing and dismantling abandoned vehicle, Building Inspection anticipates it will be 3-4 months before the affect of its program is fully evident. Introduction 1) Contra Costa County Board of Supervisors has adopted an Abandoned Vehicle Abatement Program and assigned admin- istrative responsibilities to the Building Inspection Department. 2) Area to be served is the unincorporated area of the County. B. Specifications: Towing Company will: - 1) Remove vehicles and/or automotive parts from private property at no cost to the County. 2) Respond to County request for towing within reasonable time period. 3) Provide County with insurance policy rider. C. County will: 1) Perform all paperwork and notification requirements, as stipulated by State Law and County Ordinance. 2) Notify towing company on a timely basis when service will be needed and location of vehicles or parts. D. Term of Agreement 1) Term of Agreement will be for one year from effective date, reviewed automatically unless terminated by either party, as stated below. 2) Agreement may be cancelled by either party by providing a written notice of cancellation 30 days prior to the termination date. Fujii, Deputy County Counsel Re: Abandoned Vehicles INTRODUCTION: Your memorandum of 10-30-86 requested our opinion on ( 1) what steps (e.g. , public bidding) are required to enter a towing contract with a towing company and (2 ) whether we saw any potential County liability in entering such a contract. By 11-3-86 phone conference, we were requested to ( 3 ) review the procedure proposed by the Building Inspection Department. ( 1) Contract Vehicle Code § 22671 authorizes the County to "either issue a franchise or execute a contract for the removal of abandoned vehicles in accordance with the provisions of this Chapter [ 10 ) . " Public bidding is not required. We recommend that nonexclusive contracts be entered with as many companies as are interested in such a contract. However, before any contracting decision can be made, the various available contractors should be approached. Although public bidding is not required, a request for proposals or other "feeler" could be sent out for the purpose of notifying potential contractors of the County' s interest and needs. At several past meetings , the Department was advised to obtain copies of towing contracts used by other agencies to assist in the development of a contract which will clearly delineate the -respective responsibilities of the County and the contractor, and include protective provisions for the County such as hold harmless and insurance clauses. We have not yet seen such a contract. It is essential that the contract be reviewed in connection with any procedural guideline, to insure that all procedural requirements are met. (2) Liability . Entering a towing contract will open the County to potential liability in numerous respects. Two general sources of liability readily come to mind. First, there is a possibility that the contractor will make a mistake, resulting in the contractor not Attach. 3 Phil Batchelor, County Administrator November 7, 1986 Attn: John Gregory having legal authority for removal action taken. Second, there is always the possibility that the contractor will commit a tort. Since one of the main services to be performed by the contractor is the towing of abandoned vehicles, the possibility of an accident is probably a greater concern than in other County contracts. Thus, the County should negotiate a strong indemnification clause and require liability insurance with the County named as an additional insured. We understand that the County does not intend to pay the contractor. In that case, these clauses may be difficult to negotiate. A contractor may be agreeable to such provisions however, for a fee. These are matters which should be explored as well as where risks are to be allocated. ( 3) Draft Procedure We have briefly reviewed the draft procedure for abandoned vehicles prepared by the Building Inspection Department. We have the following preliminary comments and questions. a. Investigations. We do not know the detail in which the procedures have been written. For example, if the property is not owner-occupied, the name of the occupant ( lessee/tenant) , if any, should be obtained so that that person can be notified. This is not stated in the investigations. We recommend that the procedures be as detailed and complete as possible, to minimize the possibility of failing to satisfy a procedural requirement."�- b. Abatement Notice. Aspects of the subject notice seem to be misleading. The form and our comments should be reviewed by the Building Inspection Department, as some of our comments concern policy, and not legality. Concerning the notice: 1. According to the notice, the Department is willing to remove any vehicle at no cost to the vehicle owner, property occupant or the property owner. We have no legal objection to the Department' s undertaking this public service. However, if that is the Department' s intent, it should probably be so indicatgd• n the procedures. 2 . If a property owner elects to have the vehicle removed at no cost to the property owner, must he also sign the disclaimer following the "Note?" This is unclear from the notice_ c. Hearings. This is as provided under the law. (Veh.Code § 22661(e) ; Ord.Code § 430-6.006. ) However, where the property owner has elected, at the Department' s invitation, to have the vehicle removed free of charge, these procedures need not be followed as the Department will not be placing a lien on the real property. d. Final Abatement Action. Paragraph 4 ) provides that an abandoned vehicle must be junked. Ordinance Code § 430-10.002 and Vehicle Code § 22661(f) provide that a vehicle may be reconstructed if it qualifies for horseless carriage or historical Vehicles- plates. We assume the Department has elected not to allow reconstruction of such vehicles. e. Cost Collection. A cost record need not be maintained where costs are not to be placed as a special assessment against a parcel of land, e.g. , in cases where the property owner elects to have the Department remove the vehicle for free. The Department' s procedure indicates that a cost record will be maintained for all vehicles which were "abated. " We assume the Department is only referring to situations where the property owner has not responded to the Department' s notice, has not elected to have the Department remove the vehicle for free or has taken the matter to hearing and lost. RECOMMENDATION: We recommend that the Department prepare a contract and redo the procedural guideline, utilizing the County' s Abandoned Vehicle Abatement Ordinance as a guide. We will be available to review such contract and procedures as well as provide assistance to the Department during their development. LTF:df cc: R./ W. GENERAL: The Housing Division of the Building Inspection Department is assigned the responsibility for this program. PROCEDURES: Investigation: 1) All requests to investigate a probable abandoned vehicle will have a report number assigned "RF" , utilizing the Permit Manage- ment System (PMS) . Requests should be written, but may be verbal. a) The Property Owner' s name and/or address is necessary to set up an investigation report (R-Form) . b) All vehicle abatement R-Forms will be forwarded to Housing Division for action. c) Inspection requests will be set up using Client Call-in function and inspection code of "IY" . d) Obtain name of occupant, if not the owner. 2) The inspector should obtain from the vehicle its license number, if present, and vehicle identification numbers as well as any other information available to complete "Report of Vehicle Abatement" form. (See CHP 80C - Exhibit 1) . 3 ) Send memo to Sheriff ' s Dept. listing license and VIN numbers. 4) Sheriff ' s Dept. will return a printout of DMV information to Housing Div. (See Exhibit 2) . Abatement Notice: 1) The Housing Division shall mail a ten-day "Notice of Intention to Abate and Remove an Abandoned Vehicle as a Public Nuisance," along with a copy of "Report of Vehicle Abatement" for each vehicle. Notification shall be by registered or certified mail to the owner of the land, anyone known to be in possession of the land and the owner of the vehicle (See Ord. Code Sec.430- 6.006 (a) (b) . [See Exhibit 3 for format and contents) . a) The vehicle owner, property occupant or owner may elect to have vehicle removed at no cost. Attach. 4 15-2 • Page 2 2) ' A suspense file will be established for follow-up using the computer calendar. 3 ) If the property owner elects to have the vehicle removed at no cost to him, then the Hearing Procedures are not applicable. Hearings 6 Appeals: Hearings 1) The vehicle owner, landowner of possessor of the property may, within 10 days after the mailing date of the "Notice of Intention to Abate and Remove" , request the Zoning Administrator for a public hearing; or 2) Within this 10-day period submit to the Zoning Administrator a sworn written statement denying responsibility for the vehicle' s presence with his reasons for such a denial. Said statement shall be construed as a request for a hearing which does not require his presence. 3 ) The Zoning Administrator shall immediately notify this department of any such requests or disclaimer. (See 430-8 . 002 of Ordinance Code) . 4) If no request or disclaimer is received within the 10-day period, the removal of the vehicle or parts shall proceed. 5) If a hearing is requested, the Zoning Administrator shall mail "Notice of the Hearing" at least ten days before the hearing date to concerned parties (See 430-8. 006 to 430-8. 014) . Final Abatement Action 1) After public hearing, if any, the Building Inspection Depart- ment shall make arrangements with a towing company for removal of said vehicle. A "Released-Vehicle Requirement Form" (CHP180) will be prepared on each vehicle to be removed and will• be signed by the towing company at time of pick-up. Every reasonable effort should be made to have as many vehicles as possible to be taken on one date. (See Exhibit 4) . 2) within five days after removal, we will notify DMV utilizing their form REG 104 - "Notice-Removal of Abandoned Vehicle" . (See Exhibit 5 ) . 3) A vehicle may be removed when any of the four ( 4) conditions are met, as outlined in Ord. Code Sec. 430-10.002. 4) Any vehicle towed off of private property under these pro- cedures shall be junked (crushed) or dismantled only. They can- not be returned to the owner or sold to a private party. 15-2 • Page 3 Cost Collection: 1) An itemized account of the costs incurred to abate the nuisance will be maintained on each vehicle, in order to establish actual cost to operate this program. 2) If the removal of the vehicle was not voluntary, then the cost record will be used in preparing the statement for payment by the owner. 2) Collection: If the abatement cost is not paid within 30 days after completion, such cost shall be assessed against the parcel of land. (See Ord. Sec. 430-12-002) . 4) Abatement Lien: The Director of Building Inspection shall file a "Notice of Abatement Lien" with the Tax Collector and County Recorder (See Ord. Sec. 430-12.004 and Exhibit 6) . R. W.
