APPROVE and ACCEPT the right of way contract and Grant Deed listed below: Payee and Grantor Document Date Escrow Number Amount Fukushima Nursery Right of Way 12-16-86 Founders Title Co. $575,000 Contract Escrow No. 872080 Grant Deed 12-10-86 2. APPROVE the transfer $375,000 from Flood Control Zone 3B to the Flood Control District Revolving Fund and a loan from said fund in the amount of $575 ,000 to Flood Control Zone 7, 3. AUTHORIZE the Chief Engineer of the District to execute the above right of way contract on behalf of the District, 4. AUTHORIZE the County Auditor to issue a check in the amount specified to be forward to the County Real Property Division for delivery. 5. The purchase of the entire parcel is expected to yield a net savings in project costs of approximately $100,000. It is anticipated that the repayment of the loan will occur within two years. ` BACKGROUND: The site being purchased contains several buildings, that will be impacted by the Wildcat Creek improvements. The property owner has offered to sell the entire parcel , including the improvements for the price indicated. The parcel contains approximately 10.8 acres of land. CONSEQUENCES OF NEGATIVE ACTION: Failure to purchase the entire parcel will require that we compensate the property owner for a portion of the property, three buildings , and possible severance damages.
