SUBJECT: APPROVING SECOND AMENDMENT TO CONSULTING SERVICES AGREEMENT FOR
GEOTECHNICAL SERVICES FOR SUPERIOR COURT ANNEX, MARTINEZ

Specific Request(s) or Recommendation(s) & Background & Justification
I. RECOMMENDATION
APPROVE the Second Amendment to the Consulting Services Agreement for
Geotechnical Services, and AUTHORIZE the Director .of General Services to
execute the Amendment, which will increase the Payment Limit to permit the
Consultant to provide more hours of geotechnical field services during
construction of this project.
II. FINANCIAL IMPACT:
This Amendment will increase the Agreement Payment Limit, as amended by
the First Amendment, from $32,000.00 to $40,000.00. There are sufficient
funds in the Plant acquisition account for this project to cover the
Payment Limit increase. Also, the County will be reimbursed for costs
incurred under the agreement for geotechnical services. The reimbursement
will be from the Construction fund established under the Trust Agreement
with the Contra Costa County Public Facilities Corporation, dated June 1,
1986, providing for the delivery of the 1986 Certificates of
Participation for Capital Projects IV and U.

III. REASONS FOR RECOMMENDATIONS/BACKGROUND:
A. On November 8, 1984, the Board approved a Consulting Services
Agreement with Woodward-Clyde Consultants, Oakland, California for
Geotechnical Services including soil exploration, test borings, field
& laboratory reports, foundation engineering evaluation and
recommendations.
B. The First Amendment increased the payment limit and provided for
geotechnical field services, including testing and observation of
earthwork during construction. The hours set forth in Appendix C to
the First Amendment and estimated to provide the field services
described therein were not adequate to permit the Consultant to
provide the services and properly monitor the Contractor' s
performance, particularly since the Construction Contractor's method
and schedule of operation differed from the method and schedule
anticipated by the County and the Consultant. Consequently, it is it
necessary to increase the Payment Limit so that there is adequate time
allowed to accomplish the field services specified in the First
Amendment.
