In addition to adopting this resolu- tion, I feel it is important that we schedule informational workshops on joint and several liability and tort reform., RECOMMENDED ACTION: Adopt resolution and refer to the County Administrator to contact CSAC for assistance in putting on informational workshops. CC: County Administrator ATTESTED CSAC Phil Batchelor, Clerk of the Board of CCC Taxpayers Assn SuperviSors and County Administrator M382/7-63 BY �� DEPUTY IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Endorsing the ) Fair Responsibility Act of 1986 ) RESOLUTION N0. 85/687 WHEREAS county liability costs have increased enormously over the past five years and are continuing to increase at an -alarming rate; and WHEREAS the joint and several liability 1AW- forces the county to pay for the negligence of others; and WHEREAS the joint and several liability law has made the county a "deep pocket"-and has forced the County to become a guarantor of other persons' conduct and has made the County liable for other persons' negligence; and WHEREAS the joint and several liability law and the counties' steadily increasing liability costs have contributed to the current liability insurance crisis and have caused an enormous increase in premiums and a significant reduction in coverage; and WHEREAS the insurance crisis is predicted to get worse next year as more insurance carriers leave the public entity insurance market and more public entities become unable to purchase insurance; and WHEREAS the Legislature has persistently failed to enact legislation to address the deep pocket crisis, the insurance crisis and the general crisis in public entity liability; and WHEREAS the Taxpayers for Fair Responsibility are circulating an initiative measure for submision to the voters in June of 1986 entitled "The Fair Responsibility Act of 1986"; which will'reform the joint and several liability laic and--lead to a reduction in' liability costs for counties; and WHEREAS the hope of obtaining any relief from the Legislature is very dim; and WHEREAS the county cannot continue to absorb the enormous - -- liability costs to which it is currently being exposed; NOW THEREFORE BE IT RESOLVED that the Board of Supervisors of Contra Costa County does hereby ENDORSE and SUPPORT the Fair Responsibility Act of 1986 and URGES the voters of Contra Costa County to approve it at the June 1986 General Election PASSED on November 19, 1985 by unanimous vote of the Board members present. I hereby certify that the foregoing is a true and correct copy of an order entered on the minutes of said Board of Supervisors on the date aforesaid.
