HomeMy WebLinkAboutMINUTES - 11051985 - T.4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 5 , 1985 by the following vote: AYES: Supervisor Schroder, McPeak, 'foriakson, and Fanden NOES: None ABSENT: Supervisor Powers ABSTAIN: None SUBJECT: Hearing on recommendation of the County Planning Commission with respect to rezoning application 2631-RZ and development plan #3030-85 fuled by the Robert Randall Co. (applicant) and Deer Valley Investments (owners) in the West Pittsburg area. This being the time for hearing on the recommendation of the County Planning Commission with. respect to rezoning application 2631-RZ filed by the Robert Randall Company (.applicant) and Deer Valley Investments (owners) to rezone 5 . 99 acres of land in the West Pittsburg area from Community Business District (C-B) to Planned Unit District (.P-1) and development plan application #3030-85 requesting approval of a Final Development Plan for- 120 residential units ; and Harvey Bragdon, Assistant Director of Community Development , described the property site and advised that the project would not generate any significant environmental impacts and that a Negative Declaration of Environmental Significance was issued; and The Chairwoman opened the public hearing and, no one appearing in opposition, the public hearing was closed. Board members considered the matter, IT IS ORDERED that rezoning application 2631-RZ is APPROVED as recommended by the County Planning Commission and that Development Plan 3030-85 is. also APPROVED subject to conditions imposed by the Planning Commission and the Board of Supervisors as set forth. in Exhibit A attached hereto and by reference incorporated herein, and the conditions as set forth by the..Riverview Fire Protection District as set forth in Exhibit B attached hereto and by reference incorporated herein, and the Board hereby adopts the Planning Commission's reasons , set forth in its Resolution Number 43-1985 as its determinations for this decision. IT IS FURTHER ORDERED that Ordinance Number 85-64 giving effect to the aforesaid rezoning is INTRODUCED, reading waived and November 19 , 1985 , is set for adoption of same. Company Deer Valley Investments Director of Community Development Public Works Director County Assessor County Counsel Riverview Fire Protection District CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3030-85: 1. Development shall be as shown on plans submitted with the application dated received June 14, 1985, by the Community Development Department. 2. Prior to the issuance of a building permit revised plans shall be submitted for review and approval by the Zoning Administrator conforming to Condition 1/10. B, below. This may require the reduction in the number of residential units. 3. Prior to issuance of a building permit, elevations and architectural design of buildings and structures, including carports, trash enclosures, etc., shall be subject to final review and approval by the County Zoning Administrator. The roofs and exterior walls shall be free of such objects as air conditioning equipment, television aerials, etc., or screened from view. Samples of materials and colors for exterior of units shall be submitted for review and approval. Exterior lights shall be deflected so that lights shine onto applicant's property and not toward adjacent properties. 4. Provision of a minimum of 125 square feet of private open space (i.e., enclosed private patio) for each ground floor unit and a minimum of 70 square feet of private open space (i.e., enclosed deck area) for each second floor unit. The at-grade patio areas shall be screened and landscaped for privacy of the units. 5. Prior to the issuance of building permits, landscape and irrigation plans, prepared by a registered landscape architect, shall be submitted for review and approval by the County Zoning Administrator. A cost estimate or copy of contract for landscaping improvements shall be submitted with the plan. Landscaping and irrigation shall be installed prior to occupancy. A. The proposed trees on the site shall be a minimum a 15 gallons in size. The proposed shrubs on the site shall be a minimum of 5 gallons in size. B. Trees proposed to,be planted within the public right-of-way are subject to review and approval by the Public Works Department. C. Consideration shall be given to contoured earth mounding for landscaping along the street frontages. 6. Variances to the County Parking Ordinance are approved to have less than the required dimension for parking spaces for compact cars and to have parking within setback areas as indicated on the submitted plans. The width of sidewalks, where parking overhangs are to be utilized, shall have a minimum clear-width of three feet. 7. A sign directory displaying the numbers and location of all dwelling units in a diagram manner shall be posted at each vehicular entrance and main pedestrian entrance to the project in. a location and of a size easily readable from entering vehicles. The directory shall incude annunciations as may be required by the fire district. Project identified signs not to exceed ten (10) square feet in area, may be utilized at the two Exhibit A 3030-85 pg. 2 driveway entrances. All units shall have house numbers or unit identification visible at all times which may require illumination. 8. A geotechnical report providing for foundation design and site grading shall be submitted to the Community Development Department (County Geologist) and Build- ing Inspection Departments prior to issuance of a building or grading permit. 9. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archaeologist who is certified by the Society of California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 10. Comply with the drainage, road improvements, traffic and utility requirements as f ollows: A. Widen the Lynbrook Street sidewalk to a 6-foot 6-inch width (measured from curb face. B. Construct a 20-foot paved road to private road standards along the westerly and southerly boundaries of this property. The road crowns shall be located along the property lines and the curb face shall be located 14 feet from those property lines. The road easements shall be widened to a 23-foot width along this property to provide for the ultimate width of 40 feet. C. Construct a 6-foot 6-inch sidewalk (measured from curb face) along the private roads proposed along the westerly and southerly property lines of this property and sign these private roads for "No Parking'. D. Construct Weldon Street as a 40-foot road within a 60-foot right of way from Willow Pass Road to this project. Construct curb, 6-foot 6-inch sidewalk (width measured from curb face), street lights and necessary longitudinal and transverse drainage along that street. The final number and location of the lights will be determined by the Traffic Engineer. E. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance, unless exceptions are specifically granted. F. Install all new utility distribution services underground. G. Submit a drainage analysis, prepared by a qualified engineer, analyzing the capacity of downstream drainage facilities. The hydrology shall be based on ultimate development in the watershed. If the downstream drainage facilities are inadequate, the applicant shall collect and convey the storm water run-off to the existing watercourses north of Sharon and Gregory Drives via the existing storm drainage system plus a supplementary system installed by the applicant. 3030-85 pg. 3 H. Mitigate the adverse traffic impacts attributed to this development prior to issuance of building permit, by payment of the West Pittsburg Road Fee or, comply with one of the following if the West Pittsburg Road Fee has not been adopted: 1) Contribute $187,200 to the County Road Deficiency Trust Fund for road improvements in the West Pittsburg area. 2) Construct off-site road improvements equivalent to $187,200 at site(s) identified by the Public Works Department. 11. Fencing of the northern and eastern perimeters of the project shall be provided. 12. Redesign of buildings C-1, C-3 and D-3 exteriors to screen balconies from nearby residences, shall be included. The following statements are not conditions of approval, however the applicant should be aware of these comments prior to attempting to secure building permits. A.
