Act, Section 31 ) SUBJECT: Property Exchange Marsh Creek Project No, : 7521-6D8385 Brentwood Area The Board of Supervisors as the Governing body of the Contra Costa County Flood Control and Water Conservation District RESOLVES THAT: Portions of the land acquired for the Marsh Creek flood control project, as described in Exhibit "A" attached hereto, is no longer necessary for District or other public purposes and A portion of land owned by Alexander Mena et ux, as described in Exhibit "B" attached hereto, is required for the Marsh Creek flood control project. This Board hereby APPROVES the exchange of all the District' s right, title and interest in and to said excess Marsh Creek land for the required land pursuant to Government Code Section 25526.5 and F.C.D. Act , Section 31 and the Chairwoman of this Board is hereby AUTHORIZED to execute on behalf of the District a Quitclaim Deed to Alexander Mena et ux for the property described in Exhibit "A" . The County Real Property Division is DIRECTED to cause said deed to be delivered to the Grantees .together with a copy of this Resolution. The Grant Deed from Alexander Mena et ux to Contra Costa County Flood Control and Water Conservation District dated October 11 , 1985 for the land described in Exhibit "B" is hereby ACCEPTED and the County Real Property Division is DIRECTED to have said deed recorded in the Office of the County Recorder, The Board hereby FINDS that this activity is exempt from Environmental Impact Report requirements as a Class 12 Categorical Exemption under County Guidelines and AUTHORIZES the Public Works Director to file a Notice of Exemption with the County Clerk. The project has been determined to conform to the City of Brentwood General Plan. thereby certify tha'lhfs Is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
