THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on October 22, 1985 , by the following vote:
AYES: Supervisors Powers, Schroder, McPeak, Torlakson
NOES: Supervisor Fanden
ABSENT : None
ABSTAIN: None
SUBJECT: Appeal from San Ramon Valley Planning Commission denial of
appeal on Condition 11(a) imposed by the Zoning Administrator in
approving application for minor subdivision MS 70-84.
The Board on October 8., 1985 continued to this date and
time its hearing on the appeal of N. H. Anderson and E. H.
Overholtzer (applicants and owners) from the decision of the San
Ramon Valley Area Planning Commission denying their appeal on
Condition 11(a) of the conditions imposed by the Zoning
Administrator in approving their application for a minor subdivision
dividing a 2.30 acre parcel into three lots (MS 70-84) , said pro-
perty being located on the easterly side of Ersilia Trail, approxi-
mately 800 feet north of Bunce Meadow Drive in the Alamo area.
Mr. Harvey Bragdon, Assistant Director of Community
Development, again described the project and advised that the
appellant is requesting waiver of drainage requirements as imposed
on MS 70-84 in Condition lla, and that the San Ramon Valley Area
Planning Commission had decided that any waiver of the collect and
convey requirements must be determined at the Board of Supervisors
level, and therefore the Commission denied the appeal and has no
recommendation to the Board on the matter of waiver of the collect
and convey requirements.
Mr. Boyd D. Jewett, Public Works Engineer, explained the
drainage problem in the area and how Condition 11(a) conforms to the
Board's collect and convey ordinance.
Keith Howard of Tinning & Delap, attorney for the
appellant, appeared and reviewed the project, stating that he
understood that the Planning Commission did not have the authority
to waive the conditions of the collect and convey ordinance, but
urged that the Board do so because of the hardship the enforcement
would cause to his clients.
Stephen Anderson, 2845 Miranda Avenue, Alamo, advised that
he was appearing on behalf of himself and the neighbors from Easy
Street to Bunce Meadows, urged that existing procedures be followed
and that the annual flooding problem not be increased, stating that
several times some of the neighbors had tried to get a district
formed to solve the annual flooding problem but could not get enough
support.
Board members discussed the matter in some detail,
including the lack of sufficient neighborhood interest in forming an
assessment district, and the fact that the Board has consistently
denied applications in this area because of the flooding problems.
IT IS BY THE BOARD ORDERED THAT the appeal is DENIED and
the decision of the San Ramon Valley Area Planning Commission is
UPHELD.
