SUBJECT: Notice of Determination of Abandonment and
Termination of Lease with WestAir Airlines - Buchanan Field Airport
Specific Requests or recommendations & Background and Justification
RECOMMENDED ACTION: APPROVE Notice of Determination of Abandonment and Termination of
lease with WestAir Airlines effective November 1, 1985, as provided in the lease
agreement.
FINANCIAL IMPACT: Reduction in space rental payments of $4,000 from WestAir Airlines.
The Airport is in the process of finding a new tenant for this area. Any new tenant
brought in will be at a higher rental rate which should more than compensate for the
loss of the revenue from WestAir.
REASONS OR RECOMMENDATION/BACKGROUND: Certain property was leased to WestAir for the
operation of a scheduled airline business under their lease agreement with Contra Costa
County, dated June 1, 1984. WestAir has not operated this airline business on the
property since February 10, 1985. Pursuant to paragraph 19.A.2. of their lease:
Abandonment and Vacation of Premises. "Failure to occupy and operate the premises for
thirty 30 consecutive days shall be deemed an abandonment and vacation."
This has been reviewed by the County Counsel 's Office, and they are in accord with this
recommendation.
