HomeMy WebLinkAboutMINUTES - 10221985 - 1.19 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 22, 1985 by the following vote: AYES: Supervisors Powers , Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: -None ABSTAIN: None SUBJECT: Authorize Disbursement of Liquidated Damages for Alhambra Creek Bank Repair Project near Sonora Court, Flood Control District Project No. 7505-6F7750-83, Martinez area. On June 7, 1983, the Board, sitting in its capacity as the governing body of the Contra Costa County Flood Control and Water Conser- vation District, authorized the Chief Engineer to execute cost-sharing agreements with property owners for repair of storm damage. The agreements required that the property owners engage a soils engineer to design the creek repair project and to inspect the construction work. - On June 23, 1983, the Board entered into an agreement with the Soil Conservation Service, United States Department of Agriculture, for repair of storm damage. The agreement requires that the District be liable to the Service in the amount of $130 per day for every calendar day that completion of the construction work is delayed beyond the construction contract time. The Chief Engineer has reported that the contract with Precision Seeding of Newcastle, for repair of the storm damage requires the contractor to pay $250 per day for every calendar day that completion of the construc- tion work was completed 123 days beyond the contract time, that the delay resulted in increased inspection costs to the property owners, and that their increase .in inspection costs were approximately four times those of the District. The Chief Engineer has recommended that the liquidated damages remaining after the District's liability to the Service is complete be split 80% ($11,808.00) to the property owners and 20% ($2,952.00) to the District to cover extra inspection costs.
