Adopted this Order on October 1 . 1985 , by the following vote:
AYES: Supervisors Powers , Schroder , McPeak , Torlakson and Fanden

SUBJECT: Administrative Appeal of John Hattam from decision of
Director of Community Development
This being the time for hearing the administrative appeal
of John Hattam from the decision of the Director of Community
Development and Director of Building Inspection with respect to the
application of John Rolf Hattam for a building permit for a proposed
storage area addition above an existing garage at 37 Kingston Road ,
Kensington;
Dennis Barry of the Community Development Department
appeared and reviewed Mr . Hattam' s application. Mr . Barry explained
that the permit was refused because the plans met the specifications
for living quarters rather than storage area even after Mr . Hatman
had eliminated a proposed bathroom from the plan, that the Building
Inspector had classified the structure for human habitation , and
that Mr . Hattam had been advised that the appropriate procedure
would be to apply for a Land Use Permit , or design a structure which
could be classified for storage use .
Mr . Hattam appeared in opposition to the the refusal by
the Community Development Department to grant said building permit
and urged the Board to grant same , including the bathroom which had
previously been eliminated , stating that the Land Use Permit fee
required would be in the neighborhood of $800 , and that it was not
his intent to use the addition as living space , but only for storage
and for occasional use by visiting family members or guests .
Francis T . Motofugi , 29 Kingston Road , Kensington, appeared
and commented on the history of the proposed addition and urged the
Board to deny the appeal of Mr . Hattam.
Yulia Motofugi , 29 Kingston Road , Kensington , appeared and
advised that she was representing herself and Mrs . Eleanor
Wakefield , Mr. John Chernoff, Mr . Robert Coleman and Mrs . Nancy
Brodhous , four members of the community who are unable to attend ,
and urged the Board to deny the appeal .
Chairwoman Fanden read statments in opposition to the proposed
structure from neighbors who indicated they did not wish to speak
but wished to make their concerns known to the Board .
Mr . Hattman appeared in rebuttal . The public hearing was
closed and the Board members discussed the matter in some detail .
IT IS BY THE BOARD ORDERED that the administrative appeal is
DENIED , the Zoning Administrator' s decision is upheld , and Mr .
Hattam is advised that the appropriate avenue to pursue is to apply
for a Land Use Permit .
Mr . Hattam thereupon requested that staff provide him with
a definition (more specific than what is in the code) of just what
is an accessory structure . Supervisor Powers requested that staff
provide Mr . Hattam with such a definition .
